Patient 'wouldn't have lied' about rape

Bloemfontein - A man whose terminally ill wife claimed she had been raped said on Wednesday he was disappointed that the male nurse accused of the crime was acquitted.

Dirk Lombard, who was not in court on Wednesday due to work commitments, said he was glad his wife was not alive to see the accused walk free, reported Volksblad.

Magda Lombard, 51, died from cancer a month after reporting the rape.

Her husband said she would not have lied about the rape.

But the Free State High Court found there was not enough evidence to convict Michael Moema, 33.

"Wherever she is now, she is at peace. Whoever raped her will not get past the Lord. In the next life he will be punished,” said Lombard.

Meanwhile, Moema said he was relieved after his acquittal.

As the verdict was read out, hospital staff cheered and whistled while an emotional Moema covered his face as he walked out.

Outside the court room he said the charges against him were all lies. He said he was glad the truth had come out.

    Believe me if it was my wife that was dying and she tells me she was raped and a judge sent the man free, he would wish he was put in jail. Promise!!!!!

      So you want an innocent man to be sent to jail, there is no conclusive evidence thats how courts works.

      @Jean, @johan.lombaard.3 Unbelievable you lot are! We have courts in this land (and in the ones you think are heaven on earth) and the purpose of those courts is to weigh the evidence put before them. Sometimes we like the judgments and sometimes we don't BUT the decision of the court stands until its appealed. If the man's been found not guilty ACCEPT it and move on. That's what they do elsewhere. O, johan.lombaard.3 we're no longer in that time when the answer to things you didn't like was to donder them. Unfortunately for you NOW you get dondered back and it's YOU who might wish you were in jail. These chaps don't run away from you any more - they klap back and maybe even more. Violence begets more violence and we as South Africans know that more than anyone else. There's been so much skop skiet and donder in this land that we're paying the price now. No wonder we've got all these titles thrown at us: murder capital of the world, rape capital of the world, genocide capital of the world etc etc. So grow up and accept that the courts have made their decision. It might be a k*k decision for some but that's the way it is - there will be some court decisions in the future you're gonna be happy with and which someone else will hate so....move on dude, move on!!

      Well you would go to jail for killing an innocent man. Unless you have irrefutable proof to the contrary then what was presented in a court of law?

      Not enough to make a positive ID. The hospital took too long to get the police involved according to the Judge.

    True Moema was aquitted. True he was not convicted. But it was not proven that he did not rape Ms Lombard. Too many unanswered questions..... Where did the semen come from? Why was Ms Lombard washed twice immediately after the incidence? I mean really....... Moema knows what he did and didn't do.

A forensic specialist, Katrina Botha, testified today that while male DNA was found from the forensic samples, the concentration was too low to determine a specific source. She said that she thought the source to be semen, but could not exclude the possibility of it being from another bodily fluid.

    How can there be lack of evidence? She was in a hospital where they should have rape kits and it should have been done when her husband reported it. It really sounds fishy to me.

    This guy is not a rapist. He was not found guilty of rape in a court of law. We cannot agree with courts only when it suits us.

      dofeatsdog: It is incorrect to say he is not a rapist. Sure he was acquitted, not found guilty etc. That means only that the evidence was insufficient. Is he a rapist? I don't know, neither do you.....only one person knows for sure!

      All (i.e. 100% of) acquittals that come after a trial has run its course are as a result of insufficient evidence. Evidence is required to prove guilt beyond a reasonable doubt. If the evidence is insufficient, the person walks. The accused never has to prove his innocence - like, how do you even do that? An acquittal and a decision to not prosecute are two different things. It's ok to be ignorant. But speaking with "authority" and "correcting" others while being ignorant isn't. If you feel, "#subtweeted", wear it.

    THEY NEGLECT TO SAY THAT THEY BATHER HER TWICE BEFORE TAKING SEMEN SAMPLES!!!! no wonder they cheer, they got what they wanted, raping a woman who cannot protect herself and then laughing at her poor husband. What happened to the second charge of rape, weird that there are two against the same nurse? Cry all you want, people dont make up things like this, there has to be some merit to BOTH victims claims!!!!

    Please know and understand the dynamics concerning this matter before making wild accusations and speculations also try and understand what terminally illness means. The judge made a valid and sound judgment on the matter. It was not Black nor White race relations at play.

    Not all rapes are true, people are always arrested on false counts of rape because when a woman claims she is raped,the court favours her site.

      That's the same story with every acquittal! "Not enough evidence to prove guilt beyond a reasonable doubt." Did someone tell you an acquittal is because of proof of innocence? They were smoking something.Only guilt need be proved. If it's not proved, the person walks. Give the man a break. He had his day in court, and after the whole thing, was acquitted. End of story.
