Pistorius in talks with assault accuser

2013-03-01 14:36

Johannesburg - Star athlete Oscar Pistorius, charged with murdering his girlfriend, is holding "confidential" talks to resolve a lawsuit against a woman who had accused him of assault, his lawyer said on Friday.

"There are confidential settlement negotiations under way," attorney Gary Pritchard confirmed.

The Paralympic and Olympic sprinter is suing his former neighbour Cassidy Taylor-Memmory, who in 2009 said he slammed a door at her during a party at his house.

He was arrested and spent a night in jail, but police later dropped the charge.

"It was a couple of years back. He claimed damages to his reputation from her," Pritchard told AFP of the R2.2m lawsuit.

The case is due to come before a regional court in Pretoria, the Mail & Guardian reported on Friday, but the athlete is working to resolve it quietly.

"We are trying to settle outside of court," said Pritchard.

Pistorius was released on bail a week ago after prosecutors charged him with intentionally shooting dead his girlfriend Reeva Steenkamp, 29, on Valentine's Day.

He claims he mistook her for an intruder in the dead of night.

The previous assault charge was brought up in Pistorius's bail hearing on the murder charges, and the same police officer investigated both cases.

Warrant officer Hilton Botha in 2009 rejected Taylor-Memmory's assault claims after investigating.

Last week Pistorius's legal team cast doubt over his testimony and policing after Steenkamp's killing.

Botha was pulled from the Steenkamp murder case after it emerged that he was himself facing charges of attempted murder for shooting at a minibus taxi.

Hey man that chick must be careful , she should know better. Also please don't lock the toilet door.

  • Carl Freeman - 2013-03-01 14:54

The person who is in CLOSED discussions with Oscar P I hope you are not that easily de-humanised and sell out for a few pennies or millions. If it was serious enough then for Oscar to spend the Night in PRISON over the charge of assault then what has made it any less serious? Time ? Money?

      JanGrimbeek - 2013-03-01 14:59

It will come out that it must have been money, they will call Botha as witness to tell why he dropped the original charge, and this time he will be so scared of making a mistake that he will admit the truth.

      briantebogo - 2013-03-01 15:09

Did you misunderstand the article? Oscar is the one suing for R2.2M. For the case to be settled out of court, he has to agree to receive less, or drop the case.

      Carl Freeman - 2013-03-01 15:13

Jan, Botha has said "i believed Oscar" that is why i droped the case!!!

      mike.down.5492 - 2013-03-01 15:37

Carl do you know the difference between a civil suit and a criminal charge??

      JanGrimbeek - 2013-03-01 15:49

Yes Carl, he did say that , but OP's defence discredited his words and believes and evidence to their own advantages( so they thought) so those couple of words that he uttered there will just be discredited by this other womans advocate as "not acceptable" cause it was already proven by OP's defence that his word means absolutely nothing.

      briantebogo - 2013-03-01 15:50

@Daniel How can you ask him that when he can't understand a simple news article?

      Deon Louw - 2013-03-01 16:02

Oscar spent that time (2009) a night in jail, he is now suing the woman for the dropped case.

  • dkh.khuzwayo - 2013-03-01 14:55

What a clever tactic to avoid attending court and further media scrutiny? In my books you are innocent until proven guilty but I abhor in the strongest terms the act which you admitted in court of killing someone who happens to be your sweetheart before ascertaining her identity.

  • Hansie.Crook - 2013-03-01 14:56

The remaining R900,000 of his bail was due today.... Has he paid it yet? R2.2 million? Is he trying to raise bail money from this lady? What a coincidence that Hilton Botha worked on Oscar's previous case and rejected the woman's assault claims.. Now he worked on current Oscar's case and upon cross-questioning he sided with Oscar's defence case...and did little if no investigation..

      Deziree Viljoen - 2013-03-01 15:07

His dear uncle made the payment earlier today,Hansie!

      Carl Freeman - 2013-03-01 15:10

Exactly and anyone thinks Hilton Botha was against OP must have rocks in their head. He did his utmost to discredit the state case. I am wondering how much of the evidence Hilton deliberately tampered with?

      Deziree Viljoen - 2013-03-01 15:21

Carl Freeman, you took the words right out of my mouth....!!!

      Deon Louw - 2013-03-01 16:05

Oscar might be looking for more cash as his running days seems to be over?

      Wesley - 2013-03-03 06:17

That is why all the ATM's were empty in Pretoria

  • candice.leigh.75 - 2013-03-01 14:57

Isn't it ironic that for someone whose surname is Memmory, she seems to have such selective memory about the incident. She was drunk and larey, got thrown out and kicked the door after it was shut. She injured herself. I hope that improves her recall of this situation.

      Carl Freeman - 2013-03-01 15:08

Oh here we go the Oscar story is it. That is the played down version. there is no way he would have spent the night in Prison just for slamming the door in her face. if she was in the door way and it hit her? That is assault with a object get iot Right. If Roux was on her side Oscar would be in prison now for this. Just wish Nel would step his game up!!!!

      JanGrimbeek - 2013-03-01 15:12

He was locked up that night after the incident, therefore there will still be a declaration made by her under oath that supported the reason for him being locked up, maybe it was not only BOOZE at play and maybe they were both stoned out of their minds, and all this will come out in his attempted counter case against her. So me Candice, rather go and call a seance or vigil or private prayer meeting for him that they will be able to close this case underhand with paying her instead the 2.2 to keep the real truth out of public domain

      ubervanman - 2013-03-01 16:19

yo Carl, you have a thing for Oscar! did he not sign your t-shirt or something? why would he sue her if he did what she claimed? where is the proof CARL?!! have you got images of her injuries? where you there? you make it sound like you were. why aren't you the witness then? guilty or not Oscar will get his time in court. innocent till proven guilty!

      Carl Freeman - 2013-03-01 17:28

Father Christmas yes i am please can I have another. But while i am at it even a 14 year old kid can highlight the facts and let the facts speak for them self. I am not making stuff up just what has been reported and has been said by OP. It sickens me they way people are able to throw money at problem so that they go away. And if i do one thing for those who are less fortunate i will make sure that if that is what he is doing make sure you have lots of money as you are going to need all the PR in the world to keep bolstering and rubbishing the truth i will always bring it right back to WHAT HAS ACTUALY HAPPENED! Oscar, you are only 'guilty' of 'assult' or 'premed' murder IF found guilty in a court of law, don't pay attention to hate/negative comments as if they are all perfect. What a laugh, bwhahaha. At least OP made the haters otherwise boring day LOL Oscar Pistorius, Innocent until Proven Guilty of murder or assult.

      Natasha Knipe-Carelse - 2013-03-01 15:41

Sorry to disappoint you, some of us like the current relationships we in and won't drop our current partners for anyone else to seek greener pastures. That shows true morals and dignity AND commitment to the one we're with. I'm content with what I have thank you.

      DolceLucy - 2013-03-01 15:48

Oh Natasha, but one of your previous (deleted) comments you mentioned dropping one partner for another. So where is the true show of morals and dignity really? Your self-righteous indignation is astounding. Leaving one person for another is not immoral- staying with him while entertaining another would be immoral. You clearly don't understand. Poor thing.

No Natasha, he could be guilty of Pre med Murder but still get away with it if the evidence is not conclusive enough for the state to prove we have to give him th ebenifit of the doubt. Right or Wrong?

      Natasha Knipe-Carelse - 2013-03-01 16:35

Carl you could be right but we need to let the court do their job and trust they'll do what's right as IF he's truly guilty even IF the courts find him innocent on lack of evidence there is a God where NO ONE is above the law of Christ. Until then he has the benefit of my doubt, innocent until proven guilty of premed murder with sympathy to the tragic way in which Reeva lost her life.

      DolceLucy - 2013-03-01 16:36

Ah, the irony is killing me. You choose to associate with everything you're not: 'open-minded, respectful, intelligent.' If we don't understand the comment, then we prove your point. That is an entirely meaningless saying. Well done. Pat on the back for you.

      DolceLucy - 2013-03-01 17:02

Janine- you should see some of her other atrocious comments. She likes to refer to the 'haters.' Clearly projecting.

      Natasha Knipe-Carelse - 2013-03-01 18:03

Janine I'm honored u followed me to even my fb page. As for being a christian, it doesn't mean I should be walked over. I comment on my own and its others seeking attention where they attack like bull dogs an MY comments. Don't throw the christian card when people can't handle the things I say. Christians are not door mates however if u wanna throw that card be my guest, as for mean? Its utterly horribly mean to accuse someone of murder and slander their name without evidence, that's mean. OP has as far as I know NOT been found guilty of premed murder as for me distancing myself from certain individuals its by choice before I really say things that I'll regret and not to stoop low like some. People like to judge christians as if we're super human? That's ur choice, blessings.

@ Nurse Helenk. It does matter who it is. Not only using an 8-year old as an example is implausible, but it will also point to an irresponsible parent allowing a child to walk around freely outside their own house at 3-a-clock in the morning. I am pointing out the fact that there is much better scenarios to think up than an 8-year old child.

Oscar is trying to get money for bail and also needs this case to go away as this will expose the help Mr Botha was in Oscars case. There is more history than just this. The forensics will prove that Oscar is guilty. Evryone can just wait and see for themselves. Reeva's autopsy revealed enough to put him away for life, it was just not used in the bail application as more evidence is accumalating is results come in. The Steenkamp family know he is guilty and they are behaving above reproach under the circumstances. These are such wonderfull people with Reeva being a result of their upbringing. They just want Oscar to admit that he lost his cool and did what we all know he did. There is plenty reason for his behaviour to be exposed in time to come. Hold on to your seats.

      Rika Bruwer - 2013-03-02 10:12

Hilton Botha and OP I suspect they are in kihoets. All the cases that's been dropped. No proof of OP been booked into cells 12 Sept 2009. Match fixing? Court fixing by Botha? Nair and Nel were surpriced by Botha's answers in court.

      berry.goodman - 2013-03-02 11:18

@Cats Cradle. It is a pity that he did not come clean from the start. I am sure uncle Barry does not think he is a murderer but that he lost control of his emotions and went crazy for some reason.Call it temporary insanity. He neds to have himself checked by qualified people that will not fall for charm or fame and will call a problem person a problem person. I believe Reeva wanted to help him and change him. She probably felt sorry for him to some extent. She was great at reading and understanding people but would not stand for abuse and I think for the first time that night he met his match and this got him to do what he never thought he was capable of. This is sad no matter what.I dont think most people plan to kill someone but he wanted to kill her that night and did not think rationally. The sooner he accepts his actions the sooner forgiveness can begin. He needs it more than anything right now. The legal process should be a secondary concern.

OP is suing the woman for defamation. For that one needs a substantial reputation. One needs a giant of a reputation to be awarded damages in defamation of R2,2 million. OP may have had a reputation worth that kind of money, but he won't have if he is found guilty of homicide. And that will happen as he has effectively admitted it. Right now he needs a court case with cross-examination and a wired world panting for details like he needs a hole in the head, the shoulder and the hip. Better settle then. Pay her legal expenses and scuttle back to oom se plek.

HTF do you slam a door AT someone?

      gary.gordon.961993 - 2013-03-02 19:59

You first invite the person in and then you offer no tea, then when they leave all p1ssed off, you slam the door in their face as hard as you can just as they are angrily bidding you fairwell (the technical jargon for this particular action is called "Slamming AT"). It doesn't work everytime but we get better with practise.

Hilton Botha and OP have been operation since 5 years ago. Now it is biting them in da bums. How can WO Botha with 24 years in SAPS make mistakes like he did? Has he done it on purpose? Was he intimidated by defence team? Did he got emotional involved? Match fixing vs Case fixing? 14:30- Botha says he chose not to push for Oscar Pistorius assault charge because he believed the athlete. 14:29 - Nel: So this accused knew you from before and in that matter you didn't pursue a case against him? Botha: Yes, that's correct. 14:28 - Botha says he was the investigating officer in previous matter. A docket was opened but it didn't go any further. Botha: I went to the scene. Spoke to the accused and I sent it in and matter was withdrawn. 14:27 - Magistrate asks Nel why he didn't go to the previous incident when he was arrested. Nel agrees to ask some questions. 14:25 - Botha: I knew it was him when my colonel phoned me. Had also been a previous incident at his house when he was arrested. 14:24 - Magistrate: At what point did you realise the suspect is the well known international athlete? Botha: I know Mr Pistorius. 14:22-Botha now says it is probably 300m from where the witness was. Closer than 600m. Aislinn Laing tweets: Pistorius has eyes raised for once, looking over at the policeman that's leading his prosecution, his face impassive. 14:21-Nel: Cross examination is a terrible place to be, so think carefully. Do you believe your version? Botha: Yes. Nel: I don't want to embarrass you but I want to ask you about how you measure. Are you sure about distance to lifts [of the courthouse]?
