Psychiatrist: Kotzé not accountable

Pretoria - So-called "Modimolle monster" Johan Kotzé is not accountable for his actions, a clinical psychiatrist told the North Gauteng High Court in Pretoria on Friday.

"I am of the opinion that Mr Kotzé was not accountable for the alleged actions of which he stands accused," Tertia Spannenberg said.

Spannenberg was called by Kotzé’s defence counsel as a witness.

She said Kotzé had a narcissistic personality disorder and was obsessed with Bonnette. When he saw Bonnette with another man on New Year's Eve 2011 it caused trauma, which led to stress disorder.

He became dissociated when, during an argument on 3 January 2012, Bonnette put a vibrator on the table of his Modimolle house and told Kotzé to use it on his next wife.

Spannenberg read her report on Kotzé into the court record. She first assessed Kotzé in October 2012 at the Pretoria Maximum Prison. The interview lasted four hours.

"There was a sense of urgency on his side to convey his life story to me."

‘He was very frustrated’

She told the court the parts of the attack Kotzé said he forgot were consistent throughout her assessments.

"He was very frustrated about aspects of the incidents he could not remember."
Spannenberg told the court he could not relate to the fact that Conrad Bonnette was dead.

"I cannot kill Conrad," she quoted Kotzé saying.

She said he never referred to Conrad's death in the past tense.

"I would never be able to kill Conrad. I cannot shoot Conrad."

She said this was consistent in every interview.

Kotzé is accused of orchestrating the gang-rape of his former wife and murdering his stepson Conrad, 19, in his rented home in Modimolle on 3 January 2012.

Bonnette was still married to Kotzé, but she lived in her own flat at the time.

Andries Sithole, Pieta Mohlane, and Frans Mphaka are also accused of kidnapping, assaulting, repeatedly raping, and attempting to murder Bonnette that day.

      The only way he can be non-accountable in SA is if he belongs to the cANCer society. I understand that cANCer membership is now a recognisable psychiatric disorder, requiring immediate isolation, until Jesus comes again.

    I've had ENOUGH of so-called psychiatrists trying to justify their existence and their very being by blaming EVERYBODY and EVERYTHING than on the person who comits the crime. While these guys try to find new names for imaginary psycho-problems in order to get published in the Medical journals, people are being killed and tortured because YOU tell them that they are NOT accountable for their actions.       Even if there is a "mental defficiency" and is not acoountable, this still enables him to kill, and because of this defficiency he should still be locked away for live and not be allowed to roam the streets. Society was a much healthier place before psychiatrists.

      In the new South Africa I can not be absolutely certain of this statement however the reason for psychiatric assessment in a capital offence used to be to determine whether the perpetrator should be incarcerated in a prison or detained in a secure lock up ward in a Mental Hospital where he could be monitored and medicated for as long as he lived and was deemed to be a danger to others. This allows him to be potentially rehabilitated through various methods. I know of a case where a man shot and killed his wife while she lay asleep in bed with her two very young children and left his 4 children without a mother. He did no jail time even although he admitted that he had killed her and subsequently remarried. His children have no contact with him. The law is not about revenge but about justice and the potential that the perpetrator poses a further danger to society given a similar set of circumstances. This guy looks absent - definitely not someone I'd want to meet anywhere. I hope that he is locked away for a long time.

    If he isn't accountable for his actions, then he definitely doesn't have a place in society. He should be remanded to a psychiatric ward for the remainder of his days where they can feed him mind numbing drugs so that he can reflect on his actions for the rest of his life.

      Actually Arlene, if you are unhappy with the government you can vote against them and if enough people do so there can be a change in the way everything is perceived. When the people who claim to represent the majority ignore or are incompetent and unable to do their civil service honestly then it is your and my right to exercise our right to vote. Complaining and toyitoyiing and burning infrastructure and NOT voting makes the electorate accessories to the crime and corruption.Sadly the idea of Human rights has never come with a corresponding idea of responsibility, accountability or consequence for repeated failure because the electorate keep returning the same parties to power. There is a saying that if you keep on doing what you have always done when things are obviously not working to your satisfaction you are going to keep on getting what you've been getting.     Antoinette AK is correct. A psychiatrist is a medical doctor who specialised - like any other specialist - for four years after doing housemanship (or of course after a GP practice. A psychiatrist can for instance prescribe medicines (psycologists not. Many people also confue an optometrist, who tests your eyes and give ypou glasses or contacts, with a opthamologist (spelling?), who is an eye specialist and also did four or more years specialisation after medical school. By the way, if I remember Kotze had been diagnosed by two or three psychiatrists in a state hospital who said he is mentaly fit to stand trial.

    Just for the record she is also from Bloemfontein and that is Johan Kotze playfield, strange how someone from his hometown will travel to Pretoria to listen to him, to hear his life story ... I wonder. Second opinion...Forget the State psychiatrist found him to be accountable...strangely that he will look for a female psychiatrist to testify ... Maybe that is her professional opinion but maybe looking at his conduct, him having new relationships with woman even in jail, I just think in my unprofessional opinion I will say he is guilty as sin and knew what he was doing.
