Qwelane back in court for hate speech

2013-08-28 09:02

Johannesburg - The directions hearing in the hate speech case instituted by the SA Human Rights Commission [SAHRC] against Jon Qwelane is expected to take place in the South Gauteng High Court in Johannesburg on Wednesday.

On 1 September 2011, the Johannesburg Magistrate's Court granted an application for a rescission of judgement to South Africa's ambassador to Uganda, Jon Qwelane.

SAHRC brought the hate speech case against the ambassador and was ordered to pay the costs of his legal counsel.

In April 2011, he was found guilty of hate speech, but was not present at the default judgement due to his job abroad.

Qwelane's counsel argued that the default judgement was not allowed and that an enquiry needed to be convened before such a judgement could be handed down.

While still practising as a journalist in 2008, Qwelane wrote a column published by the Sunday Sun in which he expressed his opinion about homosexuals.

The column was headlined "Call me names, but gay is NOT okay".

Qwelane was ordered to apologise through the Sunday Sun and to pay R100 000 to the commission. The money was to be used to promote gay rights.

I guess "gay is okay" after you pay.

      Mc Apple - 2013-08-28 09:34

@Moozie: Old Zuma also said that and then a week later changed his story. You off all people should know that in view of the public and internationally everything is pretty much politically correct BS.

Hey Nopenis Antigod. Your attitude tell everyone what is in your head and your heart. Sies.

      Warren van Wyk - 2013-08-28 15:07

What goes on behind closed doors between C.O.N.S.E.N.T.I.N.G. adults is none of anybodies business. I simply cannot understand how somebody can appoint themselves as the "moral authority" to tell people what their preferences should, or should not be. Imagine muslims telling christians who they can or can't marry, or can or can't worship... or vice versa? The fact of the matter is you have your own problems to concern yourself with, sort your own problems out instead of someone else's & I promise you, you will be a happier person because of that!

Lev 18:22 Thou shalt not lie with mankind, as with womankind: it is abomination. Rev 22:19 And if any man shall take away from the words of the book of this prophecy, God shall take away his part out of the book of life, and out of the holy city, and from the things which are written in this book

@Robin I'd also love to know.

      Jonathan Woods - 2013-08-28 10:03

Unfortunately Robin, people like Johan_Swart believe in those fairy stories, written by men to control mankind through fear of damnation. Really the stuff craved for by the weak minded.

      JimGordon - 2013-08-28 10:07

Johan, you SINNER - Thou shalt not judge ... that is the preserve of God. Your bible applies to you, not to the six billion people that do not subscribe to it.

      Johan_Swart - 2013-08-28 10:09

weak minded , I like your choice of words young one , I hope you will back it up when the time comes , I wager you will be silent like all the rest of your fellow heathens , it is easy to be brave when God keeps Himself hidden from your sight , we will see how brave you are when you face Him . PS I will be watching you on judgement day , remember my words then ;) smart alex

      Fumanchu - 2013-08-28 10:11

The Bible is a load of hogwash written by senile, high on poppy and hash (which grows abundantly in Iraq / Iran / Afghanistan - where most of the Old Testament was written) goat and sheep herders, less than 2500 years ago... Mankind is significantly older than that. + There is thousands of other belief systems in this world (and most of them are older than christianity). So stop thinking everyone believes in fairies and sky-gods. It's stupid.

      Evert van Staaden - 2013-08-28 10:21

Johan, just come out of the closet, you'll feel so much better about yourself. I am a Christian, and proud to say that I am, and although I am straight, I don't condemn another human being because of their lifestyle choice. It's close minded, judgemental people like you who give Christianity such a bad name.

      * DEUTERONOMY 22:13-21 If it is discovered that a bride is not a virgin, the Bible demands that she be executed by stoning immediately. * DEUTERONOMY 22:22 If a married person has sex with someone else's husband or wife, the Bible commands that both adulterers be stoned to death. * MARK 10:1-12 Divorce is strictly forbidden in both Testaments, as is remarriage of anyone who has been divorced. * LEVITICUS 18:19 The Bible forbids a married couple from having sexual intercourse during a woman's period. If they disobey, both shall be executed. * MARK 12:18-27 If a man dies childless, his widow is ordered by biblical law to have intercourse with each of his brothers in turn until she bears her deceased husband a male heir. * DEUTERONOMY 25:11-12 If a man gets into a fight with another man and his wife seeks to rescue her husband by grabbing the enemy's genitals, her hand shall be cut off and no pity shall be shown her TAKE THAT JOHAN SWART!

      Johan_Swart - 2013-08-28 10:36

@ Evert , Mat 5:17 Think not that I (Christ) have come to destroy the law, or the prophets: I am not come to destroy, but to fulfil. So you call yourself a follower of Christ , yet you make a mockery of His Fathers Law ? Perhaps you should rethink your position.

      Johan_Swart - 2013-08-28 10:51

take what ? I agree with those laws , so no shock for me there

      Evert van Staaden - 2013-08-28 11:54

I feel sorry for you Johan, and I forgive you

      Malcom Sibisi - 2013-08-28 12:01

@Johan, do not be afraid of these heathens! their time will come.

      Johan_Swart - 2013-08-28 12:27

on the contrary Evert I am the one who feels sorry for you , and I don't need to forgive you because you sinned against God so I leave it up to Him

      Jacqui Daane Van Rensburg - 2013-08-28 13:09

Hapenis Atheistis. There is a big difference between his beliefs and you mocking him. The latter is pure bad manners.

      Johan_Swart - 2013-08-28 13:22

let him mock , it is exactly what I want him to do :) mine is the game for I know the rules and the time it is to be played in , his is ignorance , trying to calculate that which he cannot see. it is a sickening feeling when the "reality" you based your assumptions on vanishes like mist and you are left to face the Son.

  • Mahlong Ralinko Ralinko - 2013-08-28 10:01

He is right though ! We still have to witness man and animals marrying, damn !

  • Mopheme Metsi - 2013-08-28 10:07

My old man - close to my heart though I do not agree with him on Gay issue.

      Johan_Swart - 2013-08-28 10:37

You should , because he is correct

      Johan_Swart - 2013-08-28 13:30

why would I report your comments ? I like pointing out your ignorance

      Johan_Swart - 2013-08-28 13:31

I think you deleted it yourself and now you are trying to save face by accusing me

  • Christopher Mark V Lowe - 2013-08-28 10:15

Hope they throw the book at this horrible, bigoted bastard!

  • Winifred Watson - 2013-08-28 10:56

Live and let live, in the past it was hidden behind closed doors today it is open. Its not our place to judge, to each his own. Today we have far worse things to worry about like rapists and murderers.

  • Wisan JW Justice - 2013-08-28 11:39

do we have any gays and or lesbians in zimbabzwe and botswana?

      Johan_Swart - 2013-08-28 12:29

the only good thing I can say about Robbert Mugabe

      Johan_Swart - 2013-08-28 13:16

spineless weaklings like you are always ashamed , regardless what others say or do

      Jacqui Daane Van Rensburg - 2013-08-28 13:17

Johan Swart. You are wagging your finger at everyone and you admire Robert Mugabes homophobic tendencies?. Isn't the law of judge not, not applicable to you?. Or are you so convinced that your place in heaven is already reserved that you feel justified, in a very pompous way, to ascertain, here and now, that some here will not make it through the pearly gates?.

      Johan_Swart - 2013-08-28 13:41

why are you concerned about what I say , I have to say it , so that on judgement they cannot say "I was not told" , it is simply your perception that tells you that I judge or "wag my finger" I simply inform and say it like it is , no need to sugarcoat it , thats the reason why we are in this mess in the first place

  • Jacqui Daane Van Rensburg - 2013-08-28 13:05

Will the SAHRC also be bringing charges against the minister of Police who fails dismally to protect the citizens of this country?.

      Johan_Swart - 2013-08-28 13:18

no , the government makes too much money out of taxing the numerous security companies that have come into existance due to their incompetance

  • Moses Mhlongo - 2013-08-28 13:50

God loves both men and women alike...he loves everyone, the righteous and sinners but hate sin. He is the only one who can judge us...we sin if we judge. Let those who believ in God be quiete and not defend him...its not your battle. Respect every human being, love your neighbour as you love your God. Jon Qwelane will face the law for his atterences...its the law of the land...let us resect as we are also commanded to respect the leaders and the adhere the their laws. Peace amongst God's people.

  • Xenswim1 - 2013-08-28 13:59

Geez some strong views herein. For me it is simple. If a man wants to be Gay or screw the dog let him but do not call upon me to recognise his needs in a manner that goes against my moral code. As there is a call for the right to an opinion to favour the Homosexual as an equal in every respect. Do not remove my right to oppose and say it as I see it.

  • Jimmy Mthombeni - 2013-08-28 14:50

Imagine if everyone was gay or lesbian; that will be the end of the world because no one will bear children. Gays and lesbians depends on normal couples (heterosexuals)for their sustainability otherwise their cycle will not be passed onto the next generation as there will be none. Qwelane I'm with you on this one.

      Jimmy Mthombeni - 2013-08-28 15:34

I'm inviting all thumbs-downer to oppose my statement with facts!
