Rape-accused youth gets bail

Cape Town - A youth accused of raping a mentally handicapped woman has been released on bail on a warning by the Cape Town Magistrate's Court, it was reported on Wednesday.

The Cape Argus reported that it was claimed the woman told a visitor, who saw she was bleeding, that the youth had raped her. He allegedly raped her four times while visiting a friend at a welfare organisation.

The woman had the mental capacity of a child aged between 7 and 10.

The youth, who may not be named until he has pleaded, appeared in court on Tuesday

The newspaper reported that although the State opposed the granting of bail, the youth was released on a warning after his defence argued that he had a fixed address and a job, and was not a flight risk.

The case was postponed until December 7.

    Beyond comprehension! I mean really, this is tantamount to raping a child, not once,but 4 times? And he is released on bail? I despair for this country of ours, I honestly do.

      I've said it time and time again, for rape, when there is reasonable suspicion that the accused did commit the crime, there should be no bail at all. Guilty till proven innocent. Being accused of raping someone four times is a serious accusation. Having a job and fixed address doesn't mean anything given the disgustingly high rape statistics. And before i get crucified fro airing my opinion, I don't mean everyone accused of rape should immediately thrown in jail, because, we all know there are also plenty of false claims of rape i.e the junior All Black player etc. Its in cases where there is a really strong suspicion that the accused did commit the crime.

      You don't know if he is guilty until found to be, What if he is innocent and spent 2 months in jail because he was not given bail. Innocent until found guilty...Remember. I agree that once convicted then throw the book at him.

    If he has a job, clearly he has no excuse for what he did. His mind is not youthful and he should be treated like any other rapist. In fact, he deserves even harder punishment for raping a disabled person! Sick man just sick

    So if you know / see any mentally handicapped woman with a child report that to police so that fathers of those children are sent to rot in jail. It doesn't matter how old,intelligent,normal that offspring is. What matters is; if you are a mentally handicapped you lose rights to sex and children. I know some mentally handicapped women who have children.

    some folks on here are just emotional, and therefore reasoning stupidly. accused people apply for, and get, bail all the time. this guy has not been convicted, this is prob the first time he is accused of something like this, ergo his employment status and fixed address come into play. remember, he has been ACCUSED of a crime, incidentally by a mentally retarded person. i cannot understand why he WOULDN'T qualify for bail quite frankly. i wonder how many N24 commentators would apply for bail they get ACCUSED of a crime????
