Rape video: Teen's 'kidnapper' may walk

Johannesburg - Charges against a man accused of kidnapping and raping a Soweto teenager, also the victim of a video-taped gang rape, were provisionally withdrawn on Friday.

No reasons were given for the withdrawal in the Roodepoort Magistrate's Court. The 37-year-old man briefly appeared wearing a windbreaker.

He had been accused of holding the 17-year-old mentally disabled girl against her will at his house in Braamfischerville, Soweto.

At an earlier court appearance, he was told to hire a lawyer, or to submit a request for Legal Aid. The girl went missing on March 21 and was found at the man's house in a search launched after police became aware of the rape video.

Four boys and three men, who matched the descriptions of rapists shown in a cellphone video of the attack, were arrested in Dobsonville, Soweto, on 17 April. The video was widely circulated on the internet from 18 April.

The four minors were granted bail by the Roodepoort Magistrate's Court on Thursday.

    Seriously there must be a very good reason for withdrwal of chargers and those of you who are angry and gnashing your teeth are you guys even sure that this man raped the girl?what if he kept her safe untill the police can find her, what if He tried asking her adress and she couldnt tell because of her mental problems?what if this man saved this woman by giving her shelter?Please consider the posibilities....If indeed this man raped this vulnarable mentally ill person then by all means he should face the full might of the law.

      @Tumisang - if she was his girlfriend, as he apparently claimed, then what was he doing with a girl with the mentality of a five year old? Why didn't he take her to the police station instead of waiting for the police to come to him if he was trying to keep her safe? If she was his girlfriend, why didn't he know where she lived, irrespective of her mental problems. Anyway, the article states 'provisionally withdrawn' - probably so that the cops can get more evidence before he is prosecuted.

      @Tumisang - I think my avatar tells you quite clearly that I am unlikely to be from Soweto. What is a 37 year-old man doing with a 17 year-old girl who has the mental capacity of a 5 year-old for a girlfriend? That is the equivalent of having sex / a relationship with a 5 year-old. The only thing that I can see as justifying her being in his house etc., is if he himself is severely mentally challenged.

    Calm down. They were provisionally withdrawn and if news24 was not as sensationalist, they would instead try and figure out why instead of making it seems as if the guy has walked scot free. This happens many a time in court and knowing news24, they will not bother telling us that the charges have been reinstated

On one extreme you have a government that is trying to pretty much ban the media to cover up their corrupt activities and on the other end, you have a reckless media that governs itself and changes rules ans regulations, grossly misleads the public and gets away with anything.     The justice system in South Africa leaves much to be desired. They needed to set an exmaple of what happens when boys violae girls sexually, how are we supposed to curb rape, if rapits get out free, given bail, cases get withdrawn, why?????????? Women are just not safe in this country, this gives men more reason to do rape beacuse they will get, no problem.

      @MarionMy point exactly. By leaving out "provisionally" they are deliberately causing a stir. Just that one word makes a VERY, VERY BIG difference and it is journalism like this that really disapoints me. I am not an avid reader of this site and once in a while when I pop in, I am greeted by stuff like this. Sometimes and I think thats what could be happening in this case, the state will not have enough strong evidence to secure a conviction and it is better off to PROVISIONNALY withdraw the case and then rearrest the suspect when you have built up a better case for him. Having said that, I understand the anger from everyone who is commenting here and rightfully so. But the journos at news24, who have a very significant reposonsibilty delibaretly conjur up stories like this to solicit such reactions.

    its justice when it follows the necessary procedures, instead of just satisfying our opinions, by come up with concrete measures. in SA we are facing a problem where media dictates of what we should know and installs a anger to the public. instead of giving us all the info necessary so that we can make rational judgements and opinions so that we don't fall to a cause of fighting each other and be in unity.

    This gets worse and worse!! That's 5 out of 8 that's haven't been charged with rape.... 4 out on R500 bail and will be relocated for their protection and the 5th charges withdrawn??? Something is wrong here especially since there is a video as evidence
