Schubart residents to learn their fate

Johannesburg - The residents of Schubart Park in Pretoria will learn whether their eviction was lawful when the Constitutional Court rules on the matter on Tuesday.

The residents were removed from the Schubart Park complex, which is owned by the Tshwane municipality, in September 2011, the court's registrar said.

They sued the municipality in the North Gauteng High Court in Pretoria to allow them to return to Schubart Park.

The court dismissed their application, but ordered the municipality to offer alternative accommodation.

The residents continued to demand that they be able to return to Schubart Park and asked the Constitutional Court to set aside the North Gauteng High Court’s judgment.

Living environment

They also asked the municipality be ordered to reconnect water and electricity services to the building.

The municipality said the complex had been an unsafe living environment, an opinion that was formed based on expert advice.

The Socio-Economic Rights Institute of SA (Seri) has also entered the case as a friend of the court.

Seri argued the removal of the residents was unlawful and the city had not provided enough alternative accommodation.

    Humanitarian and judicious it may be, but the State is good at neglecting its property. Sabie Town Hall is a needlessly abandoned brick building; the clerks rent rooms in the local hotel, and the labourers stay at home on cellphone stand-by. The Parks Board purchased the Gods Window Loop Chalet Camp. This magnificent retreat looks as if ten demolition gangs had been paid to desecrate it for six months. Nor does renting BY government solve this one. The Deeds Office in Nelspruit has just been evicted for non-payment of rent.
