Pietermaritzburg - Convicted drug trafficker Sheryl Cwele, the former wife of Minister of State Security Siyabonga Cwele, has made a last-minute appeal to Chief Justice Mogoeng Mogoeng to have her sentence of 20 years reduced back to its original 12 years, Beeld reported on Thursday.

The KwaZulu-Natal High Court originally sentenced Cwele and her co-accused, Frank Nabolisa, to 12 years in prison for drug trafficking.

They appealed their sentences, but the State's request that their sentences be increased to 20 years was granted by the appeal court.

However, there was a legal loophole when the State did not formally lodge the appeal. Nabolisa's legal team used this to appeal in the Constitutional Court against what his lawyers said was an unconstitutionally increased sentence.

The Constitutional Court found in his favour, saying the appeal court had no right to accept the State's request for an increased sentence. His sentence was reduced back to 12 years.

Following this ruling, Cwele was expected to launch her own appeal against her increased sentence. This was submitted on Wednesday, according to Beeld.

In the application, she asked the Constitutional Court to excuse the fact that the appeal was submitted late, but asked that she be treated in the same way that the court treated Nabolisa.

The court is considering the application.
