Sheryl Cwele not yet behind bars

Johannesburg - Convicted drug dealer Sheryl Cwele has not yet reported to a correctional services facility after her appeal against her drug dealing conviction failed, the department said on Tuesday morning.

Correctional Services spokesperson Nokuthula Zikhali said the department was still awaiting her arrival following her failed bid to overturn her conviction.

The former wife of State Security Minister Siyabonga Cwele, Sheryl and her co-accused Frank Nabolisa were dealt a tough hand by the Supreme Court of Appeal (SCA) on Monday when their appeals were dismissed and their convictions were increased from 12 years to 20 years.

Court president Lex Mpati said the sentence imposed by the trial court was disturbingly inappropriate.

Cwele, 50, was only appealing her conviction, while Nabolisa appealed both his conviction and sentence.

She was given three days after receipt of the judgment to hand herself over to authorities.

It was still unclear whether her attorneys had received the court's documentation by Tuesday morning.

The National Prosecuting Authority said the two could still launch an appeal with the Constitutional Court.

"[They] have 21 days to hand an application in at the Concourt," said NPA spokesperson Natasha Ramkisoon.

"But there was no indication of any constitutional grounds mentioned of this at the case," she added.

The pair were found guilty of drug dealing by the Pietermaritzburg High Court in May 2011.

Both pleaded not guilty to conspiring to deal in drugs, to procuring a woman, Charmaine Moss, to collect drugs in Turkey, and to procuring another woman, Tessa Beetge, to smuggle cocaine from South America.

Nabolisa had been in custody until now, while Cwele was out on R100 000 bail.

      I think its fantastic that she got more! Of course I do hope that she actually serves them. Its awesome that the legal systems slapped her down for appealing without grounds. Waste of time & money. Bloody mule :)

    I don't know if people at the NPA smoke something strong or just drink a lot. Why would someone appeal to the Constitutional court for a criminal matter. No one has a right to appeal to the constitutional court unless if a constitutional matter is contested. In short, the SCA is the highest court for all matters, except constitutional matters in which case the constitutional court is the highest court. Since last night's news, the NPA has been totally confusing about the fact that she can appeal to the ConCourt. Incorrect, that is why you need to employ qualified people and not friends of friends. So incompetent I am puking.

      Any good council builds in an argument relating to an infringement of rights into his appeal in order to keep the door open for an appeal to the Constitutional Court. Your statements are correct, but if you had any substantive knowledge of case law you would know that the Constitutional Court has addressed many criminal matters from common purpose (S v Thebus) to bail (S v Dlamini et al.).

    If she doesn't report for her jail term go out there and arrest her. For goodness sake you cannot let people disobey the courts decision. The same as the son of the polition if he has not paid the monies owing for his wedding go out there and arrest him, he will soon pay up. If not pass go and go straight to jail.
