Sutcliffe lawsuit: eThekwini denies liability

Durban - eThekwini municipal manager Sbu Sithole has filed a response to a R10m defamatory lawsuit brought by his predecessor Michael Sutcliffe, the Mercury reported on Tuesday.

The city has denied any liability in the case, saying if the comments were found to be defamatory, Sithole had just been doing his job.

Sutcliffe filed a lawsuit against Sithole and the city because of comments Sithole made in relation to the Manase report on alleged fraud and corruption in the city.

Sithole reportedly told the media the city had decided to pursue criminal charges against Sutcliffe and take legal action to recover R1.1m which he alleged had been lost because of Sutcliffe's failure to report fraud.

Sutcliffe claims that comments made were false and disparaging. The city denied the statements were false.

It also denied that Sithole said the Manase report had found Sutcliffe had caused the loss of R1.1m or recommended the money be recovered.

The municipality said the comments were made in the public interest.

Isn't this the same sutcliffe that wrecked durbans blue flag beach status, now it wants more money

Surely you need a character before it can be defamed. Mike the Pike must pay back what has gone missing.

After the way durbs beaches were treated he should change his name to sh|tcliffe

And the same Sutcliffe that was involved in all sorts of unhand dealings with the Durban Point project, illegally banned protests and destroyed the Durban bus system. And just a general waste of tax payers money.

Don't forget the street re-naming insisted upon by Mikey.

the truth is probably that metro mike cost durban much more than R1 million! he was the manager when durban became dirty durban and proper investigations will find that he and his brother (and son) benefitted handsomely from insider knowledge! How many metro policemen "sold" their weapons and mike did nothing about it?

Little toss head will rape more rate payers money if he wins this case and the city has to foot the bill! True colours coming out hey Sutcliffe!!!!!! You don’t care where it comes from…as long as you get it!!!

No cmments in support of Sutcliffe. How the mighty have fallen. The Manase report made allegations of fraud and corruption. Sutcliffe was in charge at the time. It is now up to the hawks to investigate and decide whether to prosecucte. On the face of it it seems Sutcliffe learnt very well from his ANC masters.
