JSC puts too much weight on race - claim

Johannesburg - The Judicial Services Commission (JSC) was putting too much weight on race, rather than on properly qualified and fit candidates when recommending judges for appointment, the FW de Klerk Foundation said on Wednesday.

"The failure of the JSC once again to recommend Jeremy Gauntlett for judicial appointment raises concerns that it is giving too much weight to race and not enough to whether candidates are fit and properly qualified," said executive director Dave Steward.

Steward was responding to reports that Cape Town advocate Gauntlett was snubbed by the JSC for a position on the Constitutional Court bench for, among other things, not having the requisite "humility".

Anyone fit and proper may be appointed as a judicial officer, said Steward.

"Candidates must also be able to act with complete independence and without fear, favour or prejudice."

The judiciary has over the past 14 years been radically transformed in terms of race.

"It is now the duty of the heads of courts to ensure that judicial education is ongoing and that appointments are made based on skill and experience, and not solely because of race - and especially not political loyalty," said Steward.

      Best man/woman for the job.... even if this person happens to be green, purple or yes EVEN WHITE, the most derogatory word in SA. Its because of BEE/AA that we now have all these incompetent criminals in leadership positions... they should be behind bars instead they living it up with the white man's taxes.

    I am tired of this story. The nation is in chaos and we are moaning about this stupid issue. People are dying in the streets, everyone is stealing anything not bolted down, and some old f**ts are arguing about a advocate. He will be in now, now and that will be that.

      Yip, this country is in utter chaos! Does anybody care? Definitely the ANC does not, they are mostly to blame for the mess!

    the JSC is systematically destroying the effectiveness of the higher courts, purely because of race. How shortsighted are these people?

    De Klerk was warned about these things happening prior to giving the country with it's values on a golden platter to the ANC. He promised that there were"checks and balances" in place. There were no checks and only blank cheques given to all the gravy train riders!
