UK woman suing SA doctor for R625.8m

2011-02-03 09:34

Johannesburg - A South African plastic surgeon now based in the UK is being sued for R625.8m by a woman who alleges he botched her facelift, the UK's MailOnline reported on Thursday.

Penny Johnson, 49, claims she was forced to stand down as director of an international financial and IT consultancy after nerve damage around her cheek and eye.

She apparently has "uncontrollable facial movement, pain around the right eye and grimacing" as a result of the "experimental" cosmetic procedure, the publication reported.

"The mother of three is seeking £54m (R625.8m) in damages from highly-experienced cosmetic surgeon, Dr Le Roux Fourie, who, she claims, tried to cover up his mistake.

"Since 2008, Dr Fourie, 55, who is originally from South Africa, has been in full-time private practice based in Methley Park Hospital, near Leeds."

According to the report, a high court heard that although Fourie admits negligence, his legal team disputes the botched surgery was to blame for Johnson's financial losses.

The publication said he could face bankruptcy if the action is successful.

A neighbour of Johnson's was quoted as saying she has been left with "a twitchy eye and she seems to have lost some weight".

@Janaman - The first thing I thought when I saw this, was, oh that forum will be so full of pro-south african bullshit. how right I was. Dambass South Africans.

why'd she need to go with experimental procedures instead of the normal run-of-the-mill type surgery? You need a patients full concent for those kinds of procedures.

      Dan - 2011-02-04 05:46

HA! HA! That's right. Tell her. wink. wink.

Errr ... she did not know it was experimental. Read the MailOnline article.

  • Trevor - 2011-02-03 10:03

You must sign a waiver when you goto surgery as ALL and ANY form of surgey carry risks...she's just trying to milk the system like the, SA will follow suit...

      Cas - 2011-02-03 10:41

Steve... you are depriving some village of an idiot... go read Trevor's line again

      ignorance - 2011-02-03 10:53

@ steve.dupreez - Sorry to dissapoint you , but Trevor has clearly stated in will "eventually" happen in South Africa. In America, we call them Ambulance Chasers. Lawyers who find loopholes to sue for money, not for the actual results of medical damages incurred, but to make money. @ Trevor - It already happens here in South Africa. I deal with Public Liability Claims, such as, when a very fat woman sits on a chair, which breaks under her and then proceeds to sue the company. She was not a customer at said institution, but someone off the street, who went into the building to use the crapper. Walking back through reception see decided to take a break, by sitting in a chair reserved for client's of said company. Video footage clearly shows the fat lard, drop her butt into the chair, in a un-lady-like fashion. Talk about contributing to your own fate.

      Maryna123 - 2011-02-03 10:56

Oi Steve - Darwin Award coming up... Trevor is not saying that she is an American, he is making the statement that Americans are suing for everything and she is following their example.

      paulmandlankosi - 2011-02-03 11:16

Please read Steve before you comment, maybe your IQ is very low

Almost everything in SA has been milked already

      Zion - 2011-02-03 17:33

Ignorance, interesting but by who and how is a common "customer" chair tested before being put on the market. Must the chair carry a nameplate indicating the maximum load it must take. And then given that the fat lady failed in her claim may any company manufacturing chairs That collapse when a normal person uses it?

      focus.ntfc - 2011-02-04 09:39

Whats the use of this comment line if NEWS24 decide who's and what comments to post??? Everybody moans abt what "Steve" said but his comments have been removed by NEWS24 .... DUHH!!! idiots

So either we take ownwership of South African born people in all aspects or we completely cast a blind eye when a Saffer is involved in any good or bad when abroad.. Stop this compromising.... the identity wil always be the same...

      Frank - 2011-02-04 05:46

what, no! what do you say to parents of kids with a harelip? dont mess with Gods work? that god sure has one ugly face. put that judgmental pointing finger down, get your bible out from under your arm, AND READ IT! you have no idea what you're talking about! you're fired!

  • Jack - 2011-02-03 10:23

Poor woman. She made a bad decision and has to live with it but her regrets shouldn’t be taken out on the doctor. A lot of people have cosmetic surgery for valid reasons other than vanity and she would deny these people his expertise by bankrupting him.

  • pointblankza - 2011-02-03 10:24

He was probably one of those who complained about AA,BEE laws and the ANC governing therefore he decided to pack up and leave..We surely wont miss his plastic surgery skills.good riddance to bad sh!t.Please dont consider coming back.. If he does come back, DR Motsoaledi must revoke his medical license.. :-)

      AJ - 2011-02-03 13:07

There is a 50/50 chance (at least) that any plastic surgeon you consult in South Africa will be worse than him. He admits a mistake but is highly experienced. Dont be naive about all the rest who remain here. Just because he left it does not make them all better than him.

      Matadoress - 2011-02-03 16:41

@Kgopotso, I've watched documentaries about SA plastic surgeon who butched them poor white girls. It was horrific. Honestly, his licence must be ripped from him and all the other scammers who remain in SA. What a bloody focked up representation of SA surgeon, thanks to the white man. I have no doubt in my mind that the women is suing this rediculous amount because this hout kop surgeon is a Southy. He must pay.

It doesn't serve her right. Nobody deserves to damaged by a doctor. I wish her luck, though. I sustained nerve damage when my oncologist was 'generous' with his radiation treatment. When he found out what he did, he ran away. Nice. I have no recourse because this is SA.

Mr Myburgh Sir.. - Should you, in error, be detained by police for a long time, in the process you lose weight. Would you consider that an acceptable price(ze) to what happened to you? - If "most of us will never see that type of money in a lifetime", what does this have to do with the story? - "she really looks like quite an arsehole to me!!" Whose arsehole, sir? Even if your comparison is true, then what's your point?

Yea, I kissed a cops ex girlfriend in a bar and he and his friends waited for me outside. Paramedics had to come and revive me at the police station. They planned to kill me, but I called my dad and he heard their plans cos I was holding my phone at my side. Then I told them that their plans were worth nothing because I had a witness. Then they pre-fabricated evidence against me, which was exposed in court --- under cross examination. All for a kiss and a swaai with a half pretty chickie that looked better after 30 J+B's than she did in her sunday bests in court.

  • pierreedge - 2011-02-03 18:19

Ubelievable, seems not even ONE of the comments here show any basic human compassion for this poor women. 1-The doctor admitted negligence did you read or you are used to accept negligence as normal here? 2-SA is a big plastic surgery destination in the world, which makes our GDP grow nicely, so all the stupid comment about vanity should consider that this vanity helps our economy a lot. 3-The women is a director of an international financial and IT consultancy, something like E&Y or PWC, so yes her earnings are probably very high, why do you systematically put the women down like that without even knowing her. I believe she is right, the doctor messed up and he should pay. For the comment about waiver, again, try to think before you speak, if such a dicument exist and clearly specifies that even negligence are not to be sued, then she wouldn'y be suing. This doc had probably to much brandy and coke before the op like all good south africans

      Wonderboy - 2011-02-03 19:34

So now you belittle the doctor by saying he was drunk. How can you make such a statement. Which people will come to SA for plastic surgery if all good South African doctors are drunk?

      Patrick - 2011-02-04 07:41

Pierre, well said. Most of these self styled commentors vent off at the least excuse, saying the most unkind and ungodly things, hiding behind the anonimity of these blogs. Would they say this in church, in cubs and so on if they were in public? I think not

      sceptic - 2011-02-04 09:18

Pierreedge, in simple South African terms you are a DOOS, So shut your face up already. You contradict yourself and quite frankly you do not make any sense at all?????????

      pierreedge - 2011-02-04 13:46

Here sceptic, have a bottle of brandy, that might make you more amicable. So everytime someone disagrees, you call them name? Nice, exactly what i expect from our fellow "intellectuals" here. Drunk or incompetent, when he admitted negligence, he showed that he is unfit to operate on people. A doctor, should always be fully focused and professional since they deal with human life.
