Winnie not above the law - DA

Johannesburg - Charges should be dropped against two policemen involved in an altercation with Winnie Madikizela-Mandela and her bodyguards two years ago, the DA said on Thursday.

"Madikizela-Mandela must realise that she, too, is subject to the laws of our country, and not above them," Democratic Alliance spokesperson on community safety Kate Lorimer said in a statement.

She found it "inconceivable" that charges were being instituted for a third time against the men.

Beeld reported that the two men appeared in Johannesburg Magistrate's Court on Tuesday on charges of intimidation and pointing a firearm.

The National Prosecuting Authority (NPA) said correct procedures were not followed when the charges were withdrawn for a second time in August.

The charges were withdrawn for the first time in September 2011, because the State prosecutor was not prepared to prosecute.

Lorimer said: "If there was not enough evidence to charge Madikizela-Mandela and her bodyguards, how can there be enough evidence to charge the policemen?"

She said the reinstatement of charges called the NPA's credibility into question.

Warrant Officer Jannie Odendaal and Constable Abel Twala would appear again in court later this month.

    Winnie, JZ, Mac, the now dead Shiceka, Yengeni, Shaik, Faku and on, and on... and on. The point is, they couldn't give a F**K for the ordinary rule of law (now where are those tapes JZ?). In a position of such overwhelming power why should any ANC cadre fear anything other than getting on the wrong side of the party (listening JuJu?). But this is not a message of despair - change is in the air, albeit only the sound of a distant whistle of a slow but irresistable train coming down the tracks. SA people are beginning to wake up to what is being done to them by this government. Payback time may be nearer than they think.

    She will get her way, she is part and parcel of ANC, she is the offender and the police must be required to reappear for carrying out the law. How can we run a country with a non-entity calling the shots. Come on DA how can we get behind these police officers and have the courts drop the case. Will this not fall under double jeapardy?

    Let us all be equal before the countries law, because if our law can have eyes to can see who should be arrested and appear before courts then there is no equality before the law and also there will be no democracy at all. If Winnie is guilty let her face court so as those two policemen. LET OUR COURTS HAVE NO EYES,LET US BE EQUAL BEFORE THEM.
