Witness: Jub Jub wasn't racing

Johannesburg - Musician Molemo "Jub Jub" Maarohanye and co-accused Themba Tshabalala were not racing when their Mini Coopers ploughed through a group of schoolchildren, the Protea Magistrate's Court heard on Friday.

A passenger in Tshabalala's car, Mpumelelo Vezi, told the court that Tshabalala was overtaking Maarohanye just before the accident.

"They were not racing because they did not take off at the same time from the stop sign, and again, Metro police were nearby," he told the court.

He said Tshabalala stopped next to Maarohanye at the stop sign to enquire whether he had managed to get directions.

Vezi, who describes himself as a friend of both the accused, said Tshabalala wanted to overtake Maarohanye in order to stop in front of him, so that he (Vezi) could move from Tshabalala's car to Maarohanye's car.

He explained that Tshabalala had other commitments to attend to.

Vezi told the court that while Tshabalala was overtaking, a minibus taxi appeared in front and Tshabalala moved to the left to avoid colliding with it. Tshabalala's Mini Cooper then hit Maarohanye's on its right side, towards the back.

Tshabalala's car rolled three times, ploughing into a group of school pupils, killing four and severely injuring two of them.

He said that after the accident, his friendship with both the accused was strained because they were not talking and relating as they did before.

"It was a difficult situation for me; I needed my space to deal with the situation," he said.

Maarohanye and Tshabalala face charges of murder, attempted murder, reckless driving, and driving under the influence of drugs and alcohol.

The trial continues.

    They report every piece of testimony this guy gives as a new news story. Give us a break! If the witness wanted to get into jub jubs car why didn't jubjub just pull over to let him do so? No need to overtake for that.

    I have dodged an oncoming vehicle twice in my life. Both times, the driver was drunk. I was doing under 60 km/h in a residential area. In both instances, I was able to evade the threat, without damaging my own car in the process. It is almost impossible to roll your car multiple times when executing an evasive maneuver - unless you are accelerating hard and speeding.

    None of this really matters. Jub jub lost control of his car, and if this loss of control was not caused by external factors such as a mechanical failure,he is guilty of reckless driving. If this reckless driving resulted in the injury or death of any living thing, then he is guilty of causing this. It is actually very simple.

    So we must apparently assume from this latest evidence that the kids who so tragically died were travelling at one heck of a speed when they collided with the innocent cars passing them by. BS, I say.

    Paleez...the story telling is becoming tiresome, just tell the truth, face the music and go to jail. It is the least they can do after taking the lies of innocent by standers due to their hedonistic irresponsible behaviour.

    If this guy gets away with it, it will be an absolute slap in the face of all the people that lost loved ones that night. This guy is trying each & every way 2 get out of the charges. How reliable is the witness? It sounds like he has been bought. Facts are that they weren't sober & were driving @ high speeds on public roads which led to the death of the youngsters. As society it is our duty to protect the younger generation, let us not fail them.

    Their stories keep on changing, it's really hard to keep up and knowing how screwed up our justice system is I can foresee Jub-jub and his friend walking. Another thing, whether they were racing or not is of no relevance because children lost their lives.

      OK, I agree with the sentiments expressed in the comments - most of them at least - and with your's, but how in the world do you get from all this to a screwed up justice system? Can't blame the system for ppl getting to Crt and "raping" their own conscience. If this guy was called by the Publ Pros the latter should be taking time to think long and hard as to why he/she did this! But I suspect he is testifying obo the 2 accused. They deserve to be punished hard if convicted. The Cape Crt showed the way.

    ok wait ¤thinking¤ earlier it was reported that jub jub was actualy a passenger now he was driving again, which is it. I honestly feel sorry for tshabalala, talk about back stabbing friends. I am fairly new to driving, but isnt it law to only overtake when it is totally safe? If the judge falls for all these lies, than i give up on our courts.

    Sounds dodgy to me. Time unfortunately stretches the "truth" and now a different story is being told. I also wonder how much this witness has been paid.
