Bloemfontein – The two drivers who allegedly swapped seats when a bus carrying 65 ANC members overturned on the N1 in April, have been summoned to appear in the Winburg Regional Court, Free State police say.

They would appear for the first time on January 24 2017, said police spokesperson Captain Malebo Khosana on Tuesday.

This follows the Director of Public Prosecutions' decision to prosecute them after a thorough investigation by Winburg SAPS Detective Unit members, Khosana said.

The drivers face charges of culpable homicide and reckless and negligent driving.

“Their names will be issued after they have been formally charged,” he said.

In April, Khosana said a 31-year-old driver was briefly detained for his role in the accident.

"The other driver was still at a hospital in Welkom where he is stable, but could not talk to the investigating official," he said at the time.

The bus was carrying ANC members to Ekurhuleni, in Gauteng, after they had attended the launch of the ANC's local government elections manifesto in Port Elizabeth on Saturday.

Ten ANC members died in the crash.
