Conviction, life sentence imposed on man who raped teen boy confirmed

Pietermaritzburg - High court judges of appeal on Tuesday confirmed the conviction and life sentence imposed on a 43-year-old man who raped a teenage boy in 2012.

In a victim impact statement the 14-year-old youngster wrote that after the rape he had started to drink alcohol and smoke cigarettes. Whenever he saw the person who had abused him, he felt “scared and grumpy”.

He also said he felt that he was a “joke” and that his class and schoolmates were laughing at him.

Themba Mbanjwa was found guilty of rape arising from the incident by a Pietermaritzburg regional court magistrate.

According to court papers, the boy testified that he had been playing in the road when Mbanjwa (whom he knew) asked him to go with him to play. He accompanied him to his house and they had played on a gaming console.

When it was getting dark the boy asked to leave, but Mbanjwa refused. He locked the burglar gate and told the teen he was “going nowhere”.

The youth said when he tried to shout Mbanjwa threatened him.

After a while he fell asleep.

Mbanjwa woke him later and then raped him. He told him not to tell anyone but the teenager reported the incident to his mother. A doctor who examined the boy found evidence of rape.

Mbanjwa’s appeal against his conviction and sentence was dismissed by judges ­Johan Ploos van Amstel and Thoba ­Poyo-Dlwati.
