Johannesburg - Nkululeko "Flabba" Habedi's killer was granted bail in the High Court sitting in Palm Ridge, just barely an hour after being sentenced to 12 years behind bars.

Sindisiwe Manqele's lawyer, Norman Makhubela, had quickly put in an application to file for bail, pending leave to file an application to appeal her sentence and conviction.

Makhubela put it to Judge Solly Sithole that his client, who had been out on R15 000 bail as she awaited her sentencing, would be willing to put up an additional R10 000.

Sithole agreed and granted Manqele bail of R25 000.

She has to report to a local police station twice a week, is barred from leaving the province without the permission of the investigating officer and her passport will remain in the possession of the state.

In the interim, Manqele would be allocated a prison number as well as an ankle bracelet to monitor her movements.

Mutual jealousy

The 27-year-old fatally stabbed her lover Habedi a year ago following an argument.

Earlier, Sithole had delivered the sentence, stating that he had shown mercy to her by giving her less than the prescribed minimum sentence of 15 years for murder.

"When I show you mercy, it does not mean that you are smart or clever and the court is stupid. I show you mercy because mercy is part of justice in itself," said Sithole.

He said he took into consideration the fact that Manqele had tried to resuscitate him until "his eyes were popping out".

Sithole also said Manqele was a victim of mutual jealousy.

She was a first offender and stood a good chance of being rehabilitated.

He said, in other countries, a crime like this was punishable by death.

"It's a very serious offence in every language... It is so serious that I cannot think of another crime more serious than that... except for treason," he said.

Sithole told Manqele that in the United States, murder was punishable by execution, through the administration of a lethal injection.

In other African countries, "they take you to a ditch and have a firing squad open fire on you", he said.

"If you take the life of another person, you get punished for that. Whether it be the life of a child, a lover... That is not acceptable in any society," Sithole said.

Sithole referenced that the couple argued at Habedi's house, where "fuck you" was heard many times.

"One cringes to use it in a court of law," he said.

Manqele was expected back in court on April 12 where her lawyer was expected to file his application.
