Labour Court dismisses KZN prison commissioner's urgent application

Johannesburg - The Labour Court has dismissed an urgent application brought by the department of correctional services's KwaZulu-Natal regional commissioner, Mnikelwa Nxele, to have his suspension overturned.

The national department of correctional services on Wednesday said the court was not convinced that there was any urgency, nor any basis, to nullify the suspension.

The matter was struck off the roll and would be heard on March 15.

"Mr Nxele’s suspension follows allegations of acts of gross insubordination, as well as failure to implement instructions of the national office," said national commissioner of the department, Zach Modise.

"Disciplinary processes are under way," he said, adding that further details relating to the suspension would not be made public, as this was between the department and Nxele.

Nxele was suspended last week with immediate effect.
