Chetty: Conspiracy to commit - Accused 4 gets 15 years.

24 Nov 09:53
Chetty says Jayde had been blissfully unaware that the man she shared a bed with had set in motion plans to have her killed.

24 Nov 09:52
Chetty says the packed gallery showed the empathy for the Inggs family and due consideration needed to be given.

24 Nov 09:52
Chetty says that it is evident from Toni's testimony that the murder and aftermath has had a significant impact.

24 Nov 09:52
He says that the submission that he had withdrawn from the conspiracy was not substantiated, as if he did, he had the opportunity to say so.

24 Nov 09:52
Chetty says in Sibeko's case it is somewhat different.

24 Nov 09:52
He says that Nenembe is prone to violence.

24 Nov 09:52
Chetty says Nenembe has a dual personality, that of a student at university and that of a life of crime.

24 Nov 09:52
Chetty says his actions showed he was an intimate member of the plot.

24 Nov 09:52
"I found that accused 3 was on the scene when Jayde was shot and there was nothing to indicate he was a passive bystander."

24 Nov 09:51

24 Nov 09:51
He says the acquaintance in the plan was aggravated by money.

24 Nov 09:51

Chetty deals with accused 3 and 4.

He says the evidence showed that R80k was money destined for the execution.

24 Nov 09:50
He says while he has no doubt of their plight, he cannot overlook the hurt of the Inggs family.

24 Nov 09:50

This was apparent from his defence indicating that they would seek an appeal before sentencing.

He accepts that they are a close-knit family.

24 Nov 09:49

Chetty says that in the trial, it was apparent that Chris had taken no responsibility of his action.

He has remained indifferent, defiant, and persists in avoiding all responsibility.

24 Nov 09:48

Chetty says the embryo of Chris' defence was revealed during the second bail application.

Chetty says that in the application, Panayiotou had said that, regardless of what was said in the event, he was merely doing what the police had told him to do, and he was trying to get information for them.

24 Nov 09:48

Chetty quotes from Panayiotou's affidavit:

"I loved my wife", he says.

The pretence began with his opening affidavit and escalated throughout the trial.

24 Nov 09:46

The great irony of the trial was his attempt to portray himself as a doting husband.

He cautioned Jayde not to stand on the pavement outside the complex.

24 Nov 09:45

Chetty says that when the body was found, he does not dispute that when she was found, both her father and father-in-law had shed a tear.

But that if Chris shed a tear, based on his own involvement in the murder, he can only deduce that they were "crocodile tears".

24 Nov 09:44

24 Nov 09:42
Chetty says that Panayiotou continued to search for Jayde throughout the day.

24 Nov 09:42

Chetty says Panayiotou's behaviour after her death showed his Machiavellian personality.

Chetty says he attempted to fool friends and family.

24 Nov 09:42
Chetty says at the centre was the diabolical plot to murder Jayde, and Chris' money acted as the catalyst to her death.

24 Nov 09:41

Chetty says it was open to the accused to testify in his own defence in mitigation.

Chetty says it is wholly unnecessary to regurgitate his findings.

24 Nov 09:40
Chetty says when Price addressed the court on the 17th, he asked for a postponement, saying he needed to deal with the judgment and to draft a pre-sentence report.

24 Nov 09:37
He says it would be foolish not to acknowledge that there is a tendency to use past rulings to determine whether a prescribed minimum sentence is just or not.

24 Nov 09:37
Chetty says it would be an impossible task of listing a comprehensive list of what circumstances can be deemed compelling or substantive.

24 Nov 09:37

There has been some uncertainty whether substantial and compelling should be dealt with together or separate.

Chetty says it is his opinion of dealing with them separately.

24 Nov 09:36

Chetty is addressing what consists of mitigating or aggravating circumstances.

A departure may be justified by circumstances that are seen as substantial or compelling.

24 Nov 09:36
Conspiracy to murder carries a sentence the same as that of being committed.

24 Nov 09:32
Sentence of premeditated murder is life.

24 Nov 09:32
Court is in session.

24 Nov 09:32
