Man sentenced to community service for attack on cop

Pietermaritzburg - A municipal worker convicted of a number of charges, including biting a policeman on his arm to prevent him from making an arrest, has been sentenced to undergo correctional supervision.

Magistrate Chetna Singh sentenced Mandla Buthelezi (43) of Nxamalala to three years in terms of correctional supervision legislation.

In terms of the court order, Buthelezi will be required to undergo 16 hours of community service per month for 30 months.

He will also be detained under house arrest and will have to undergo skills and life orientation programmes during his sentence.

The sentence arises from an incident on November 3 last year when two policemen were assaulted while trying to make an arrest. One was bitten on his forearm in the incident.

Buthelezi was found to be the man responsible and was found guilty of four charges of defeating the ends of justice, resisting arrest, assault with intent to do grievous bodily harm as well as common assault.

A photograph of the bleeding wound inflicted on the forearm of Warrant Officer Vasilios Konstantopoulos during the fracas, was attached to the charge sheet before court.

The court heard evidence that the drama erupted after Sergeant J.C. van Tonder and Konstantopoulos stopped after witnessing an accident in Mayor’s Walk and tried to arrest the driver of a taxi involved.

Buthelezi, who was a bystander, intervened and struck Van Tonder in the face with a clenched fist and bit his colleague.

He also thereafter resisted arrest.

According to the correctional supervision report handed to court, Buthelezi was working for Msunduzi Municipality at the time. He is married with four children.
