Cape Town - A new date has been set for the DA's application to have deputy national director of public prosecutions Nomgcobo Jiba suspended.

The matter was called off on Tuesday when Mokgoatji Dolamo's mother died and the hearing had to be rescheduled to give the judge some personal time.

The application has been rescheduled for 10 February.

The DA hopes to get the court to agree that President Jacob Zuma has failed to act over several grievances against Jiba.

Zuma has responded to calls to suspend her by saying he is waiting for the outcome of a General Council of the Bar application to have her struck off the roll as an advocate.

According to the DA, Jiba has allegedly lied to court, failed to comply with court orders, ignored deadlines, failed to exercise an independent mind and shielded "irrational and illegal actions from judicial scrutiny”.

She also allowed Zuma and his lawyers to decide which parts of the transcripts of the controversial "spy tapes" would be released after the opposition got an order for access to the transcripts.

The tapes purportedly contain conversations that indicate that there was interference in the course of investigating the corruption charges Zuma and a French arms company once faced.

The charges were withdrawn by former National Director of Public Prosections Mokotedi Mpshe just before Zuma was sworn in as president in 2009.
