Johannesburg – The rector of North West University will vacate his post a month before his contract ends, the institution announced on Friday.

The university said that following a meeting with the university's council on Thursday, a settlement was reached which would see Professor Herman van Schalkwyk vacate his post on December 31.

"Council has resolved to settle the matter, including an ex gratia payment to him. No further details with regard to the agreement between him and council will be made known," the institution said in a statement.

Van Schalkwyk has served as the rector of the university since January 1 2010.

Explaining Van Schalkwyk's departure, the institution said at the time of the appointment of the current vice-chancellor at the end of 2013, the then-council decided to extend Van Schalkwyk's term as campus rector and vice-principal.

This would have coincided with the term of the vice chancellor, which comes to an end in 2020.

"However, at an extraordinary meeting of council, held on March 21 2015, council resolved to follow the solicited external legal advice that any purported attempt to extend the term of office of the campus rector of the NWU's Potchefstroom Campus would constitute illegal and, therefore, invalid conduct on the part of council."

Thursday's meeting was to clear up uncertainties regarding Van Schalkwyk's stay at the institution.

The council apologised to Van Schalkwyk.

"Council regrets the delay that was caused by the uncertainty... and particularly regrets the inconvenience which the delay undoubtedly must have caused Prof Van Schalkwyk and his family," it said.
