Pretoria – The National Prosecuting Authority's Nomgcobo Jiba and Lawrence Mrwebi, who were struck off the roll of advocates, will be able to ask the appeals court to review their case.

The High Court in Pretoria granted them leave to appeal on Monday, Netwerk24 reported.

Jiba is the deputy national director of public prosecutions and Mrwebi the special director of public prosecutions.

Jiba and Mrwebi were struck off the roll on September 15 2016, by Judge Francis Legodi, who concurred with the General Council of the Bar of SA that they were "not fit and proper" for their jobs.

This followed their decision to drop charges against former crime intelligence head Richard Mdluli, who was facing a number of indictments, including defrauding a secret slush fund.

They were both placed on special leave.

President Jacob Zuma asked the two in October to make representations on why they should not be suspended, following their disbarment.

They have told Zuma that suspending them would be unlawful.
