Johannesburg - The Helen Suzman Foundation (HSF) and Freedom Under Law (FUL) on Friday asked the Hawks and NPA not to arrest Finance Minister Pravin Gordhan.

They wanted undertakings, by no later than 12:00 on Monday, that Gordhan would not be arrested on any criminal charges, the two organisations said in a letter.

Should he face those charges, HSF and FUL wanted at least 20 days’ notice to apply for a court interdict.

Gordhan received a letter from the Hawks on August 22, calling on him to make a “warning statement”. It related to the establishment of the so-called “rogue unit” at the SA Revenue Service and the early retirement and re-appointment of Sars deputy commissioner Ivan Pillay.

In their letter, FUL and HSF pointed out that the Hawks’ allegations were without foundation, but if there were a basis for prosecution, any threat, or attempt, to arrest him would be a manifest abuse of process, intended to harass, humiliate and intimidate.

“FUL and HSF contend that the administration of justice, the economy and the Republic itself have already been gravely endangered by the Hawks and NPA's actions against the minister and that the undertakings they seek are urgently required if further calamitous consequences are to be avoided,” lawyers for FUL and HSF said in a combined statement.
