ANC: Shivambu also charged

Johannesburg - ANC Youth League spokesperson Floyd Shivambu has also been charged, along with league president Julius Malema, with violating the ANC constitution, the ANC said on Friday.

"Comrade Julius Malema has been charged with various violations of the ANC constitution, including bringing the ANC into disrepute through his utterances and statements on Botswana and sowing divisions in the ranks of the African National Congress," said national disciplinary committee chairperson Derek Hanekom said.

"The disciplinary matter concerning Comrade Julius is now in the hands of the ANC national disciplinary committee, which will henceforth deal with the date, venue and time of the hearing."

Malema would have an opportunity to defend himself at a disciplinary hearing. He would be entitled to representation by a member of the ANC in good standing.

Shivambu staying mum

ANC spokesperson Keith Khoza said Shivambu had also been served with a charge sheet on Friday. The charges also related to bringing the ANC into disrepute and sowing divisions.

Shivambu could not immediately be reached for comment.

Malema recently said the league would send a team to Botswana to consolidate local opposition parties and help bring about regime change, as it believed the government there was "in full co-operation with imperialists" and was undermining the "African agenda".

The ANC reacted angrily to the comments, publicly rebuking the youth league.

The league responded to this, saying it did not believe it was in the wrong or going against ANC policy. It expressed disappointment at being publicly rebuked before the matter had been internally discussed.

Statement withdrawn

ANC secretary general Gwede Mantashe then clarified the ANC's approach to neighbouring countries and said the league's taking on the ruling party publicly constituted a "serious transgression".

Last week, the ANC's top six leaders were to have met the ANCYL's newly elected national executive committee about, among other things, the Botswana matter.

However, in a separate meeting, the ANC officials decided to postpone the talks to separate the issue of meeting the ANCYL's new leadership from possible disciplinary action to be taken about its comments on Botswana.

On Saturday, faced with the prospect of being disciplined, the ANCYL withdrew the statement on Botswana and apologised to the ANC. However, weekend reports indicated that this was not enough and the ANC would press on with charges against the league leadership.

Last year, Malema was found guilty on a charge relating to a public attack on President Jacob Zuma in an ANC disciplinary hearing.

He also pleaded guilty to this charge. He attacked Zuma for rebuking him in public and compared him to his predecessor, Thabo Mbeki while addressing the media on April 11.

The national disciplinary committee at the time said should Malema be found guilty of provoking serious divisions or a break-down of unity in the organisation within the next two years, his membership of the ANC would be suspended.

    Oh wont it be wonderful if Malema is suspended from the ANC. He would lose his ANCYL president position with it, and therefore his powerful position getting tenders etc for his company. The house of cards would come tumbling down and he would have to stop building his R16m mansion. If this happens, I give him 2 year and he will be back living in a squatter camp. This man has no decent education, no skills, no sophistication, nothing to offer an employer. Without the ANC and their tenders he is nothing and will be on the streets like the millions of others who he is so happy to speak for but steal from by tender rigging. The same goes for Shivambu. This would be justice indeed. We will wait and see. We can but hope.

Or was Zuma's ascendancy to power such a priority that we could take brainless stoogies and make them leaders of our youth? The ANC needs to look at this matter seriously. Previous leaders of the YL like Nelson Mandela, Lulu Johnson, Peter Mokaba, Parks Mankahlana, Malusi Gigaba, Fikile Mbalula had a million times more brain powder than these two.

    Malema will probably get away with a R20 fine suspended for 50 years. Nothing will come of the so-called "charge". This is just an effort to draw the public's attention away from the more serious charges regarding finances which Malema has to face. They won't really act against him. He'll most probably be promoted to Vice-President of South Africa soon. Maybe he just need to build up about 600 cases of corruption against him to strengthen his case!!

    Please note the colour of the comitee chairman. The ANC does this when it is in a corner. It uses it white cadre to avoid having fingers pointed at others. I have noted this when difficult questions are asked of parastatals or the main manna do not want to face the music.
