Abortion Act declared invalid

Johannesburg - The Abortion Act and the Traditional Health Practitioner Amendment Act were declared invalid by the Constitutional Court on Thursday.

In its judgment, the court said parliament had failed in its obligation to allow reasonable and sufficient public participation before the bills were promulgated and enacted.

The invalidation was suspended for 18 months to give parliament the opportunity to remedy its oversight and to comply with its constitutional duties regarding public participation.

A challenge by Doctors for Life International on the validity of two other acts, the Dental Technicians and Sterilisation Amendment Acts, was dismissed.
