Dangerous weapons bill criticised

Cape Town - A bill outlawing toy guns, pepper spray, knives and other "dangerous weapons" in public places is on its way to Parliament.

newspaper reported on Monday that people found with certain objects in "suspicious circumstances" will not be able to use self defence as an argument in court and could face up to three years in prison.

Freedom Front Plus MP Pieter Groenewald criticised the draft dangerous weapons bill, which was published recently in the government gazette.

The proposed law, he said, would allow the police to arrest people "left and right".

"The fact that you will not be able to use self defence as a defence also makes the bill unconstitutional," he said.

The bill defines a dangerous weapon as "any object" that cause injury or have the ability to take a person temporarily "out of action".

It says that an object can be classified as dangerous even if there is a suspicion or fear that someone may be injured.

"A woman walking late at night with pepper spray in her purse could also be rounded up because she might not be able to argue that the spray is for self defence," Groenewald said.

The public has until Sunday to comment on the draft bill.

      The hilarious part is that this law relates to "any object" that cause injury or have the ability to take a person temporarily "out of action", meaning anything from a spade to a hammer to a kitchen knife. So, it will be as easy as arresting people outside the hardware store for buying dangerous objects. Also, don't carry around glass bottles, or you may be arrested, as they may be broken and used as weapons. I can see that our esteemed government has really thought long and hard about this one.

SA is arguably the most dangerous place on earth - yet you are not allowed to defend yourself. This is not only in gross violation of the constitution, it is a blatant attack on the most fundamental of all human rights - the right to defend your own life. We seem to forget that the 'government' is there to serve the people, not the other way around - in principal, citizens hand their weapons to a government in good faith, as such then in agreement that the said government will protect them. If not, or worse, if the government become the aggressor, then this agreement is nullified by default.

      The police have lost 20 000 firearms since 2004. Last year it was announced the SANDF could not account for 82 000 weapons. There are no real statistics on the number of illegal firearms entering the country on an annual basis. The ANC was requested to surrender their arms caches in the run up to the first free elections, but they refused to do so and have never declared where they are of if they have in fact been destroyed. And now the ANC want to talk about dangerous weapons? Pepper spray and toy guns? Because they are concerned about my safety? I’m not convinced.

      As a policeman in South Africa, Western Cape, I use my own discretion when I find weapons of any sort on a person. A skurk with an okapi is one thing, but an old man with a knippel is not worth the fuss. Somewhere someone abused a biltong knife, or pellet gun and everyone pays the price. What about the pen that I carry in my pocket, or my belt buckle, or my walking stick? I will have to use something to defend myself. Where will they draw the line? What I understand here is that I will ultimately, by law, not be able to defend myself in any way. It is arbitrary and subjective and allows the SAPS powers to arrest for arbitrary reasons. It will cause more corruption. Think "Hmmm that can of coke looks like a weapon, hand it over". Most gun owners carry guns and knives. Under this bill, he could be arrested for the knife but but because he is licenced the gun is ok. Unless he can prove its for biltong... This is absurd.     Yeah the bill in principle is good, as it may lead to a curb in unnecessary violence and criminals may be stopped before committing a crime... THe problem is that we live i a didgy society where too many criminals have weapons and there would be no way to stop them from hurting people. Once the police force is alot more effective (Not sleeping on the job) and there is less corruption and better organization then it might work. But unfortunately it would leave room for craziness and abuse by police. Pepper spray is an improtant form of self defence for women and with the high rape stats it would be a really bad idea. Plus the bill leaves room for misintepretation as to what constitutes an object that may inflect harm... Eish these politicians and their wording!!

      In NZ it is illegal to have pepper spray. When I got there for a holiday, they confiscated mine. I could have been fined or jailed. But they could see I really just didn't know.

    How self-defense can be excluded as a possible or contributing factor to explain that the circumstances were not suspicious is difficult to justify. Those who are not inclined to carry traditional weapons will of course have reason to be slightly less worried. Nobody will agree that if you commit a crime, or intend to commit it, that you should be allowed to arm yourself to defend yourself in the commission of the crime. Perhaps that is what the “suspicious circumstances” refer to; a situation in which the object is likely to be used to commit a crime. If that is so there should not be a problem. Self-protection and protection of property is not supposed to be a crime. If an explanation of self-defense is excluded as an explanation – which seems to be the case – the suspect who honestly carries an object intended for self-defense will ALWAYS be guilty under the proposed law. If you walk down the street on your way to the café with pepper spray and you are perhaps not too grandly dressed, you will always be vulnerable to arrest if the law enforcement officer and the court are allowed or even obliged to ignore your explanation of self-preservation.

      crackerr : Do you honestly trust our police and justice system to correctly apply the definition of self defense? How many false arrests have we already had where people have been beaten up and thrown in jail only to be released without explanation of either arrest or release? SA doesnt need a bill like this! In fact, we need to loosen up our gun control. Remember, licensed firearms are almost never used to commit crimes. Its the illegal and stolen arms that are used. Criminals by definition do not obey the law. So implementing any sort of law like this only aids the criminals. But then, thats what the government wants, isnt it?
