Free State ANC PEC invalid - ConCourt

Johannesburg - The Constitutional Court declared the ANC's Free State provincial elective conference invalid, in a judgment handed down in Johannesburg on Friday.

"The provincial elective conference of Free State province of the African National Congress held at Parys on 21-23 June 2012 and its decisions and resolutions are declared unlawful and invalid," the judgment said.

An appeal was brought by six Free State ANC members who challenged the validity of the PEC in court last month, claiming elections at branch level were irregular.

The party begins its conference on Sunday.

      Didi, your ANC leaders must educated you about the separation of powers between the executive, parliament and the judiciary (courts). The executive makes laws, parliament passes those laws and the judiciary checks whether those laws are legally enforceable and are complied with, WHEN asked to as in this case. Hands off the courts boet neh

    it is a vandication to those comrades who were consistent 2 say the PEC of the free state province doesn't represent them due 2 irregularities that occured during the provincial elective conference.Gwede mantashe as the general secretary of the anc should be ashamed of himself.the judgement by the constitutional court it's indication that victory is certain in mangaung.ppl must expect many surprises there.forwad with change forwad

    It serves the ANC right. They should learn to work for the people and not against the people. This bulldozing of policy over its supporters is so unANC, that we grew up knowing.     Not a great a story, but indicative of leaders breaking known protocols simply because of self-first not the people. If this foreign trend continues in the ANC, the party will collapse. Very disappointed in the leadership of Ace whom I adored way back.

      Hi Siphiwo, what makes you say that this is a 'foreign trend' when we have seen at least two decades of growing corruption, nepotism, self-centredness and plain arrogance? Surely by now we can't call it 'foreign'? It's not the guys from Nigeria or 'the West' or anywhere else who started it here, surely? Or is Snabir Shaik, JZ and the thousands of others all influenced by a 'foreign' force?

      Moses I am sure the courts have better things to do, but when an application is brought before them they are required to follow through with it. Not like tha ANC who would just ignore it if they could not make some money out of it

    I fail to understand how this ruling will benefit the so called disgruntled members as the party constitution makes it crystal clear that any member that takes the party to court will have expelled themselves from the party. The ANC must crack the whip on these power hungry members who drag the party into the abyss before it is too late

      The ANC,not Inkatha co-wrote the Constitution,it is bound by it.In matured denocracy,not in ,ulundi_Inkatha you dint get expelled for seeking justice in court if feel inside is bias.,go back where you belongmyou are not ANC material.
