Zuma drops Zapiro claim to R100 000

2012-10-24 22:36

Johannesburg - President Jacob Zuma has reduced his claim against cartoonist Zapiro from R4m to R100 000, media lawyer Dario Milo said on Wednesday.

He has also dropped a claim that Zapiro's Lady Justice rape cartoon harmed his dignity, said Milo, who represents the Sunday Times newspaper.

However, Zuma was still claiming that the cartoon harmed his reputation.

Milo said there was a slight difference between dignity and reputation.

"Dignity is basically an insult where you claim for hurt feelings in circumstances where the reasonable person would also have been hurt.

"Reputation is where you claim for harm caused because other people think less of you as a result of the cartoon."

The claim related to the cartoon, depicting Zuma preparing to rape "Lady Justice", which was published in the newspaper on 7 September 2008.

Zuma started proceedings in December 2010 against Avusa, the cartoonist Jonathan Shapiro and former Sunday Times' editor-in-chief Mondli Makhanya in a summons issued in the South Gauteng High Court in Johannesburg.

He was demanding R4m from Avusa, Makhanya and Shapiro for harming his dignity and damaging his reputation.

He has now reduced the claim to R100 000.

Zuma wanted an unconditional apology.

In the cartoon, Zuma, who was acquitted of a rape charge in 2006, was shown loosening his trousers while since expelled African National Congress Youth League president Julius Malema, Congress of SA Trade Unions general secretary Zwelinzima Vavi, SA Communist Party general secretary Blade Nzimande and ANC secretary general Gwede Mantashe hold Lady Justice down, saying: "Go for it, boss."

The matter is scheduled to be heard in the High Court in Johannesburg on Monday.

\Reputation is where you claim for harm caused because other people think less of you as a result of the cartoon.\. We all think less of you everyday. No cartoon did that, but ur daily actions. Raping the tax payers, raping lady Justice and seems you gonna wipe urself with the constitution now. Well done mr president.

I'm incredibly angry that we have a buffoon running this beautiful country full of extraordinary people; so much potential being lost by greed and corruption...make no mistake, we live in a dictatorship!

Yeah, the United Kingdom has their King/Queen, we on the other hand, live in a country.

Zuma is on the back foot and he has shown his Achilles heel'. He won't last too long!

      gerrit.vanpletzen - 2012-10-25 05:52

If you're on the back foot and have an achilles heel the logical conclusion is a great fall.

  • Maxodin - 2012-10-24 23:23

If the president wants to sue someone for causing him loss of respect and damaging his reputation perhaps he should sue himself for making comments like "I took a shower" and actions like having five wives and 20 children. Now that would be justice!

  • jacques.vandermerwe.140 - 2012-10-24 23:27

I hope the courts find Zapiro guilty and award Zuma R1.00 ~ which would be 100% in line with what his reputation is worth. That way the Zuma family may have to sell a mine to cover the cost of the trail.

      infijar.ken - 2012-10-24 23:36

Sounds like a good idea, but, NO! Being guilty would mean Zapiro would have to apologise. That costs more thanR1. It would be preferable for the court to find for the defendant, and then award costs against the plaintiff! Then see who would pay, not the spear for sure.

      John - 2012-10-24 23:47

Can't argue - zumer is definitely a 'head' of his time...

      parys.fotograaf - 2012-10-25 13:08

  • daniel.machet - 2012-10-25 00:10

wow... shows how fickle public office can be - 3 years ago he was riding high on the wave of public popularity and was swinging the club at the lowly cartoonist, now he has to win back support and has cap in hand

  • gerrit.vanpletzen - 2012-10-25 05:31

At the outset when the claim was filed Zuma's reputation was harmed to an amount of R 4 m. Now the damage is only worth R100 K. If we wait 2 months we will find that he will have to Pay Zapiro.

  • numerofigo - 2012-10-25 05:40

  • Gatvol Griet - 2012-10-25 06:16

No! Why, Zapiro's cartoons are what makes us tolerate the adiot! I am ashamed of my country brcause of him!

  • sefako.mokgalaka - 2012-10-25 06:30

Zuma is more concerned about his private life than doing his work as a president. It's all about his ego and nothing else.

  • B.b. - 2012-10-25 06:34

I don't think Zuma want Zapiro's money,,,he was just joking with this R4m,,,when Zapiro comes to him R100k he'll (Zuma) say, \keep it,,,I don't buy my reputation or dignity\... Whenever u r dehumanizing somebody else, u r also dehumanizing urself indirectly,,,just like the way the white people did to our forefathers,,,when they were dehumanizing them, they were also dehumanizing themselves by showing that they lack humanity,,,they were like animals,,,an animal always think of killing everytime it sees something different from it,,,

      george.casper.315 - 2012-10-25 09:10

      Huh ?

      jacqui.daanevanrensburg - 2012-10-25 14:13

B.b. Actually animals only kill when hungry or frightened. Can you explain how a cartoon about Zuma got you to think of racism?. Or is racism always on your mind preventing you from moving forward?.

  • Vince.York - 2012-10-25 06:39

When is zuma being impeached and indicted for ALL the crimes and then zumaville stripped from the tribal trust and placed under curatorship and rented out to tourists as Zuma's Folly to recoup some public funds? All the zuma's should be stripped of all assets and SA and foreign banks should freeze all zuma related accounts

  • Lee.CPT.ZA - 2012-10-25 06:41

Can I not be deemed as being a friend of the court? I would welcome the opportunity to tell the court what the average man in the street thought of Z before and after the cartoon was printed!

  • gregory.jurgens - 2012-10-25 06:47

Hate to taint his reputation as a corrupt, womanizing thief, with a insatiable thirst for public funds.

  • johleneh - 2012-10-25 07:04

I think South African citizens should sue Zuma for harming the international reputation of South Africa and for hurting our dignity as we do not enjoy the constitutional rights we should, such as a safe country! Stoopidspear Showerhead is a disgrace!

  • julie.meissenheimer - 2012-10-25 07:05

What dignity???? What reputation????? You have neither!!!!!!

  • clinton.bowden1 - 2012-10-25 07:09

If anything, I feel the SA Nation ought to sue zuma for damage to Dignity and Reputation. Lindiwe Mazibuko has a point, zuma did break sa.

  • long.tom.509 - 2012-10-25 07:10

I thought it rather inhanced his reputation, that and his spear.

  • UMvelase - 2012-10-25 07:12

  • andre.vandeventer.16 - 2012-10-25 07:15

Come on guys and girls, mr Zuma does have a reputation. It's not a good one though!

  • bill.mckimm.9 - 2012-10-25 07:16

His reputation is lower than shark s..t already! how can anyone damage that reputation. The real shame is he is damaging the reputation of the country and damaging our collective dignity. Maybe we should be suing him?

  • Lubabalo Mkiva - 2012-10-25 07:21

Zuma is our president and also your president after him there will be another president (whether you like it or not) whom you people still will despise. Fortunately you people will never get to govern again. And dont talk about scandals and corruption as if the country was wealthy when the ANC took over.

      demi.cooke.7 - 2012-10-25 07:38

I think im going to throw people like you still exist?

      gregory.jurgens - 2012-10-25 07:54

Zuma is a rapist and a thief.

      ndumiso.gagayi - 2012-10-25 07:57

      And your point is?

      lums.zindela - 2012-10-25 08:52

... Zapiro is our cartoonist and yours too, I think you must respect that

      sean.odonnell.1466126 - 2012-10-25 09:22

This is irony at it's best seem to despise whites, yet you have the emblem of a European Football Club on your Fb profile. Some would call that hypocrisy.

      jacqui.daanevanrensburg - 2012-10-25 14:18

Lubabalo Mkiva. Yes, there will be another president and another and we will keep complaining and despising while thieves and corrupt idiots rule. That is OUR democratic right and be darn sure we will make use of it. If you are comfortable with thieves be my guest, but don't expect us to stick our heads in the sand next to yours.
