Ultra-Orthodox Jews to serve in army

Jerusalem - The supreme court has struck down as unconstitutional a controversial law which has allowed ultra-Orthodox Jews to defer their service in the Israeli military.

The ruling, handed down late on Tuesday, could affect the future of tens of thousands of ultra-Orthodox Jews who have so far been able to avoid military service by proving active enrolment in religious studies.

The so-called Tal Law had been promoted as a way to encourage ultra-Orthodox Jews to serve in the military, by offering them an opportunity to serve a shorter term than their compatriots, or do civil service instead.

But it also codified a long time understanding which meant ultra-Orthodox Jews able to prove their enrolment in religious studies were exempted from military service - an agreement that has angered many other Israelis.

The court on Tuesday found that the law had effectively failed in its stated purpose of attracting increased service by the ultra-Orthodox, with statistics showing ever greater numbers of them are instead receiving exemptions.

"This law is not constitutional and the parliament cannot extend its application in this form when it expires on August 1 2012," the ruling said.

In failing to attract more ultra-Orthodox to the military, the law had merely codified a system that unfairly exempts part of society from the burden of army service, the court said.

The controversial law, which was passed in 2002, prompted many Israelis to question why part of society should be insulated from service in one of the country's most important institutions.

Military service is compulsory for Israelis over the age of 18, with men serving three years and women two years.

I think this is good. It's easy for people to encourage military action when they're not actually being involved in that action. By being directly involved, it should become clearer to the ultra-orthodox Jews that war is failure.

Fred... I guess you have never lived in a country that is consistently threatened by its neighbors and attacked on a regular basis. Of course war is not pretty and all parties suffer because of its consequences, but there is such a thing as self defense. Not responding to belligerent actions brings more of the same... and that is a failure .

I agree. But I also know there's blind hatred for "the Arabs" among Jewish people, which I hope would be reduced, not only by the diminishing dictatorships, but also direct involvement in the fighting most of the ultra-orthodox Jews promote, quite often rabidly.

fred i dont know as much as other do about what goes on there - i certinaly know more then other who like to pretend they know whats going on... when you speak of blind hatred of arabs by israelis i dont doubt that for 1 second, but what can be truthfully said is that no matter how deep their hatred runs, the israelis do not butcher palestinian families in their sleep, ot teach their children that their mission is kill as many jews as possible. neither do they celebrate the deaths of palestinians by dancing in the streets, or even take palestinians hostage for years with out access to medical care or any form of communication with the out side world. no individual or nation on this earth is perfect, but when looked at from a far, its very clear that one side has a true evil embedded in them. for the love of christ please dont answer this post with the line, "yes and that side is the ractist israelis...." cos it simply isnt, the israelis have offered olive branches of peave too many times to count and all they have every gotten in return is rockets and suicide bombers. the palestinians make it no secret that peace is not an option, so why people come here and try explain that it is, is beyond me.

      Fred - 2012-02-23 00:01

Adam, I agree completely with what you've said.

      Fred - 2012-02-23 00:07

Sorry, except that I don't believe the Palestinian people have "a true evil embedded in them". That there are Palestinians who do evil there's no doubt, as with all cultures and nationalities. I think the Palestinians have allowed themselves to be used by the unelected, self-serving dictators of the region. With these gone, the Palestinians will have to, be able to think for themselves. They won't have all that funding, and more importantly won't be used as a scapegoat to a material extent any longer.

      Fred - 2012-02-23 00:14

I want to add also, that I think the blind hatred among some Jewish people towards "Arabs" is directly associated with fear, fear of being exterminated again. This is where these tyrants have been evil. They have failed to understand what the Jewish people have been through, even completed negated it in the case of Ahmedinejad and his chauvinistic Ayahyollas. And they've used the Palestinians for their own self-serving aim of holding onto power.

      Fred - 2012-02-23 02:55

Israeli's are looking at their fear, encountering it, the ogres in the personas of the tyrannical, violent, lying dictators and in Islamic fundamentalism, so close in nature to the Nazis
