Killing that sparked boy to 'divorce' his dad going to court

Boston — A murder case that prompted a boy to seek a "divorce" from his father is going before Massachusetts' top court 18 years after the killing.

Daniel Holland was convicted of first-degree murder in the 1998 fatal shooting of his estranged wife and is serving a life sentence.

The couple's 8-year-old son, Patrick, found his mother's body. Years later, he won a ground-breaking legal battle to terminate his father's parental rights.

Holland is appealing a judge's refusal to grant him a new trial, arguing that his lawyers failed to present evidence of his mental health issues.

The state Supreme Judicial Court is scheduled to hear arguments on Thursday.
