Alleged baby killer to resurrect bail bid

A man accused of killing his baby by using her as a weapon to beat his girlfriend is to resurrect his bid for bail, having previously abandoned it, the Pretoria Magistrate's Court heard on Wednesday.

Alexander Forba, 32, appeared in court via video-link from where he was being kept in custody. Wearing a grey hoodie, he was asked by magistrate M Naidoo if he spoke English.

Forba replied: "I speak English, broken English."

His attorney Bronwinn Marshall, from Legal Aid, said pidgin English was a specific dialect in Cameroon, where Forba was from.

Prosecutor Sipho Letsoalo said investigations into the matter had been finalised, but the indictments had yet to be served upon Forba in person.

He said the matter would also be transferred to the High Court, with the dates given being December 7 to 11.

"However, the indictments have to be served on the accused," he said.

"We shall however respect this honourable court to remand the matter to the 19th of May to serve the indictments on the accused. This has been agreed by the state and the defence."

Bail abandoned

Marshall confirmed this. She said she had abandoned Forba's bail application in March as per instructions received, and last consulted with Forba on Friday. Those instructions had not changed.

Letsoalo said: "There is an indication that the accused [Forba] has another attorney who has not yet come on record."

Naidoo said to Forba that it had been indicated in court he had another attorney, with Letsoalo confirming that he had spoken to the new attorney.

It emerged that Forba had changed his mind on applying for bail, telling the court via the video-link that his new lawyer would launch a bid for bail.

"I want him to apply for bail for me. That's what I want him to do," he said.

New lawyer

Naidoo asked Forba about Marshall withdrawing and getting a new lawyer.

Forba said: "No, I have nothing to say to her [Marshall]...Ja, I want to get my own lawyer."

Marshall then withdrew as Forba's attorney, with Naidoo unhappy that Forba's new lawyer was not present in court.

The matter was stood down for a few minutes as Letsoalo attempted to call Forba's new lawyer, but the phone went unanswered.

Proceedings were then postponed to Thursday, with Forba to appear in person with his new lawyer.
