Heidi Klum has asked the court for an emergency hearing.
In a declaration, obtained by People, the former supermodel claims ex-husband, Seal, is preventing her from taking their children with her to Germany where she is to film Next Top Model, for coronavirus concerns.
The couple, who were married for nine years, share four children together.
The 47-year-old claims the children spend most of their time with her. "Henry's [Seal] time with our children is sporadic at best," she wrote.
According to Heidi, Seal "has not yet approved of this trip".
Heidi said in her declaration that she's taken every precaution to ensure the safety of their kids and is willing to alter their custody schedule so Seal gets to spend Christmas with their children.
"I tried to work this out with Henry directly to no avail," Heidi added, saying she is "desperate" and that the children have said they do not want to stay in Los Angeles with their dad.
Leni, the former A-list couple's eldest child, wrote a letter to her father as well as the court, reports Vulture, saying her siblings are "frightened" at the thought of being away from their mom for so long.
"This is hard because I love both of my parents, but I feel like I need to speak up," she said. "I understand that my siblings are too young to speak to the judge, so I am happy to speak for all of us. My mom needs to film in Germany for a few months and my siblings and I want to go with her.
"So far, my dad is not allowing us to go, though we have tried to tell him our reasons why we want to."
