These were the submissions made by Masuku’s legal representatives, senior counsel William Mokhari and Mbuso Majozi, before a full bench at the Pretoria High Court on Thursday, as Masuku sought to review the findings, have them declared invalid and set aside.
Mokhari had a hard time proving that the reports were final and thus reviewable. He argued that according to the SIU’s responding affidavit, “the two reports were final and recommendations binding, hence could be taken on a legality review, not on promotion of administrative justice review”.
