Only a fraction of non-residential buildings have obtained Energy Performance Certificates (EPC) ahead of the 7 December 2022 deadline, and those that fail to do so risk of being fined, imprisoned, or both.

The requirement for an Energy Performance Certificate (EPC) was gazetted on 8 December 2020, and owners of non-residential properties have had two years to comply. It applies to government buildings of more than 1 000 square metres and privately-owned buildings of more than 2 000 square metres. Examples include office blocks, entertainment facilities, educational institution buildings and places of assembly such as sporting facilities and community centres. 

Those that do not comply with the EPC requirement face a fine of up to R5 million, or five years' imprisonment, or both, according to the South African National Energy Development Institute (SANEDI). SANEDI maintains an EPC register on behalf of the Department of Mineral Resources and Energy (DMRE).
