Gordhan withheld crucial documents on SAA sale, says unhappy bidder

The company suing Public Enterprises Minister Pravin Gordhan over the transaction to sell 51% of SAA says he has refused to hand over numerous documents detailing his decision and has gone to court urgently to compel him to do so.

Lawyers for Toto Investments say that although Gordhan had more than three months to compile the record of decision, he has provided only "217 pages of materially deficient documentation" despite asking for more time to comply because the record was "voluminous". Rule 53 of the rules of court compels Gordhan to deliver a record of proceedings on the decision to select the Takatso consortium as the preferred bidder for SAA.

In its application, Toto lists dozens of documents that Gordhan has withheld that were evidently or obviously part of the decision-making process. The application will be heard in the Western Cape High Court next week.
