Regulator to appeal after court ruled in Eskom's favour in battle over tariffs

The legal wrangle between Eskom and the regulator over tariffs is set to continue, with the National Energy Regulator of South Africa saying it intends to appeal a ruling handed down by the High Court in Eskom's favour last week.

The High Court in Johannesburg on 28 July reviewed and set aside a a decision by Nersa to deduct a R69-billion equity injection from the power company's allowable revenue for the current three-year period, instructing instead that the full amount must be reinstated to the embattled utility's allowable revenue for the next three years, Fin24 previously reported.

This, in turn, could potentially impact Eskom's tariff increase application for the three-year period to 2022 - meaning it can charge a higher tariff.
