Stop delaying tactics and pay back R11m, Solidarity demands of Molefe

Cape Town – Trade union Solidarity has upped the ante in its efforts to get former Eskom CEO Brian Molefe to pay back R11m to the utility, in compliance with a recent high court ruling.

The R11m relates to a R30m pension payout Molefe was given by Eskom. He lost an appeal bid at the South Gauteng High Court and was ordered to pay back the R11m he had already received.

Head of labour law services for Solidarity Anton van der Bijl said there was no response from Molefe’s legal advisers to a written request for him to pay the money back.

“We haven’t received any adequate response from Molefe or his legal team since our letter directed to them on April 18. The time for Molefe to pay back the money has now finally run out and it is thus inescapable for Molefe to pay back the pension money he received unlawfully,” said Van der Bijl.

Van der Bijl said the former Eskom CEO is buying time by “dragging his feet” in complying with court rulings.

“Molefe’s tactic to postpone paying back the money clearly failed, since the court rejected his application for leave to appeal with costs. With these enforcement steps, the trade union now urgently demands Molefe to pay back the money taken from taxpayers’ pockets immediately,” said Van der Bijl.

Molefe told Fin24 that he has not seen any letter from Solidarity, but understands that his legal advisers received a letter from the union.

“I don’t know exactly what the demand was. I haven’t seen it. They have written to my legal (team) and I am sure that they will notify me of the latest developments.

"We will have a meeting and we will decide what the next step will be from there,” said Molefe.
