In November we hired someone for our Debtors department. This person signed a 3 month probation letter. This person also signed a contract stating that 22 days written notice must be given for resignation after 6 weeks service.

The company shut down on the 21st December. All employees hadto put in for annual leave.
Anyway, this person was paid and got pro rata 13th cheque.
When the company opened on 7th January the employee didnt return to work, just sent an email stating resigning with immediate effect.
Can the company sue this person?
