Section 197 - my rights
Hi,

Two months ago our CTO announced at a staff briefing that our functions was not going to be outsourced.

A few days ago they announce that they are now applying a section 197, i.e. that our functions are being outsourced. This is a direct contradiction to the CTO announcement. I, like many others, have let a few good opportunities pass by based on the information given to us by the CTO.

Regardless of the missed opportunities, what are our legal options, if any? Also, we are given only a few days to accept this option or told to resign.

If in fact the outsourcing is going to be done as a going concern, then it is Section 197 and all the contracts of employment are transferred to the new employer.
