Domestic workers’ annual wage increase

ANNUAL minimum wage increases for domestic workers are operative as from 1 DecemberĀ­ to 30 November, 2016.

In Umvoti, which is classified as Area B, the minimum wage for domestic workers who work more than 27 hours per week is as follows:

Hourly rate: R10.23 (previously R9.30)

Weekly rate: R460.15 (previously R418.32)

Monthly rate: R1993.82 (previously 1812.57)

Minimum wages for domestic workers who work 27 hours or less per week:

Hourly rate: R12.07(previously 10.98)

Weekly rate: R325.98 (previously R296.35)

Monthly rate: R1413.49 (previously 1284.09).

In major metropolitan areas the monthly rate is R2 230.70 with R11.44 the hourly rate for worker more than 27 hours. For 27 and less the hourly rate is R13.39 and monthly is R1 566.35.

According to the applicable legislation, domestics should work no more than 45 hours a week, and should not work more than nine hours a day if they work a five-day week, or more than eight hours a day if they work more than five days a week.
They should work no more than 15 hours a week overtime, but never more than 12 hours on any one day.
Overtime is at one-and-a-half times the normal wage (or the employee may agree to receiveĀ­ paid time off) and should also receive double pay on Sundays or public holidays.

Employers whose domestics live on the property may deduct 10% of their salary for accommodation, providing the accommodation complies with the minimum standards laid down in the legislation.

An employer wishing to dismiss a worker must give a week of notice if the domestic has been employed for six months or less, and four weeks' notice if he or she has worked for more than six months.

Domestics are also entitled to severance pay of one week for each year of service, as well as four months' unpaid maternity leave.

The services of an employee may not be terminated unless a valid and fair reason exists and fair procedure is followed.
This is outlined in the LabourĀ­ Relations Act (Code of Good Practice, in Schedule 8).
