The threshold for rape conviction in South Africa is too high, argues Ben Winks, in light of a recent rape acquittal. Winks writes that our threshold is too protective of male sexual entitlement and not protective enough of women in particular, in our country with excruciatingly high incidences of sexual violence.

This month, the Grahamstown High Court overturned a young man's conviction of having raped his then girlfriend in 2018.

The judgment has generated an important debate about whether the court correctly approached the vital concept of consent in sexual offence cases.
