If the NPA chooses to drop prosecutions against Julius Malema after Friday's Constitutional Court ruling, it will send a very clear message to the EFF leader and his party that inciting people to illegally occupy land will not have any criminal justice consequences, writes Karyn Maughan.
The legislation under which Economic Freedom Fighters leader Julius Malema was charged for inciting his supporters to occupy vacant land has been invalidated by the Constitutional Court - opening up a clear path for him to argue that the cases against him should be dropped.
Within hours of the ruling being released, the EFF released a statement claiming that the decision "entails that the charges brought against our President can no longer stand". It stated:
