A John Hlophe leadership at the Constitutional Court will ensure more Bongani Bongo type discharges, a greater deference to populist politics, and a move away from the courts as a guarantor of constitutional governance, which is why it is no surprise Julius Malema is supporting Hlophe for position of Chief Justice, writes Serjeant at the Bar.

Last week the Judicial Service Commission (JSC) completed its interviews and made recommendations for appointment to the judicial office. The process was bookended by the interviews for the Constitutional Court and those for the Western Cape High Court.

Thus, led by Dali Mpofu SC, and turbocharged by Julius Malema, key interviews were based almost exclusively on identity.
