The majority judgment of the Constitutional Court on Friday in the land case involving Julius Malema accepts that the crime of incitement requires intention on the part of the accused to be proved in order that a conviction can be obtained, but the majority fails to deal with the obvious consequence, argues Serjeant at the Bar.
