A landmark decision by the Western Cape High Court over the sale of land in Sea Point puts the ball in the Western Cape government's court, writes Serjeant at the Bar. 

In January 2016, the Western Cape government sold a derelict property, which had once housed Ellerslie and Tafelberg schools, to the Phyllis Jowell Jewish Day School for R135 million.

The decision gave rise to extensive litigation designed to set aside the sale which was initiated by a social movement Reclaim the City (RTC). The litigation assumed considerable importance, given the lamentable failure of successive provincial and local governments to alter the spatial geography of a city that continues by and large to look like the Cape Town of the apartheid period.
