It is astounding that this government which should not have learnt  its constitutional obligations concerning access to health care  from the TAC litigation decided by the Constitutional Court has left the country in this level of anxiety about a coherent vaccine response, writes Serjeant at the Bar.

Further announcements will be made in due course. So said President Cyril Ramaphosa about the availability of the much needed vaccine when he announced the commencement of Level 3 restrictions. This is not the language of a democracy, where the citizenry are entitled to be governed by a constitutionally accountable government on which is imposed an obligation to ensure that everyone is entitled to access to health care.

The constitutional delinquency which is sourced in the notion that the citizenry must wait for its rulers is compounded by the different and contradictory messages that have emanated from government regarding the arrival of the vaccine in South Africa.
