PROMOTIONAL CAMPAIGN TERMS AND CONDITIONS 1. Promotor: Unless stated otherwise in the promotional campaign details, the promotor is Sun International. 2. Deemed Acceptance: Every participant participating in this promotional campaign shall be deemed to have read and accepted these Promotional Campaign Terms and Conditions by virtue of their participation. 3. Entry Process: 3.1. Entry is free and will be in accordance with the process set out in the promotional campaign details. 3.2. Unless stated otherwise in the promotional campaign details, the promotional campaign is closed to any persons who are directors, members, partners, employees, or agents of Sun International (including their spouses, life partners, business partners or immediate family members) or any other person who directly or indirectly controls or is controlled by Sun International or its marketing service providers. 3.3. Participants must be 18 (eighteen) years or older and excluded persons (i.e. self-excluded persons, persons refused access, or any other category of excluded persons) are prohibited from participating in the promotional campaign. The promotional campaign is exclusive to South African residents only with a valid identity number and/or passport (as the case may be). 3.4. The Promoter reserves the right to terminate this promotional campaign immediately. In the event of such termination, all participants agree to waive any rights that they may have in terms of this promotional campaign and acknowledge that they will have no recourse against Sun International, its related-parties, management, employees and agents. 3.5. Client will keep data for the legally allowed timeframe after which (including third party agent) will ensure it is safely destroyed. 4. Selection Process 4.1. Media24 will select the prize winner by random draw after the closing date. 4.2. Incomplete entries will result in the participant’s immediate disqualification without notice being required. 4.3. The prize winner will be notified telephonically and confirmation of the award of the prize(s) will be sent via email using the participant’s contact details provided. The prize winner must acknowledge receipt of the prize(s) by signing the Winner’s Declaration form attached to the Letter of Award within the time period specified therein, failing which the prize winner will forfeit the prize and a new prize winner will be selected. 4.4. Media24 will take all reasonable steps to notify the prize winner, however, if Media24 is unable to contact the prize winner within 48 (forty-eight) hours of it being selected and after three phone calls, then a new prize winner shall be selected. 4.5. All decisions relating to awarding the prize(s) to a prize winner shall be at Media24’s sole discretion, are final and binding, and no correspondence or appeals will be entered into in this regard with a participant. 4.6. It is possible for technical failures or system malfunctions to occur. In the event of technical failure or damage to the device used for the random draw or selection (if applicable), irrespective of the cause, another suitable device or method will be used, within Sun International’s sole discretion. In such instance, Sun International, its related-parties, management, employees and agents shall not accept any liability for any damages, loss or claim whatsoever and howsoever arising out of the afore-going occurrences. 5. Prize(s) 5.1. The prize winner accepts the prize(s) at its own risk. All pictures and photos used to advertise the prizes are illustrative rather than definitive and are for reference only; the actual prizes may differ in their appearance. Any advertisement of the cash value of the prize-pool represents Sun International’s best estimate of the normal retail-price. 5.2. Each prize is not redeemable for cash, is not transferable and may not be sold or exchanged. 5.3. Redemption and use of the prizes are subject to the time period stated in the promotional campaign overview and the Letter of Award. No refund will be issued to the participant for any unused portion of the prize. 5.4. The prizes may vary across the participating Sun International business operations. The prizes are subject to availability and excludes peak periods applicable to the hotel(s) mentioned in the promotional campaign. If for any reason the prize (or any components thereof) are not available, Sun International in its sole discretion reserves the right to substitute another prize of equal value. 5.5. In addition to paragraph 5.4, the offer and award of the prize may be subject to change without prior notice in compliance with the prevailing level of lockdown as advised by the South African Government. Due to select Sun International hotels being open at this time, Sun International reserves the right to move any reservation from the original hotel at which the booking was made to another Sun International property in the same or similar location. 5.6. All accommodation is subject to availability and Sun International’s standard booking procedures including (but not limited to) guests who do not check out on time will be charged in full and no-shows at the hotel will be charged a 100% (one hundred percent) cancellation fee. 5.7. Once a booking has been made and confirmation sent to the participant’s email address provided, no amendments thereto shall be accepted, including in respect of the date and choice of Sun International hotel chosen by the participant. 5.8. Unless the promotional campaign specifically states otherwise, the prize excludes travel, transfers to and from the hotel, travel insurance, additional entertainment and activities, meals, and any other items of a personal nature not included in the Prize Letter. All incidentals of whatsoever nature incurred by the prize winner during their stay shall be charged to the prize winner and payable prior to the prize winner’s departure. 5.9. Activities are strictly subject to availability and bookings are essential upon arrival with the hotel concierge. All guests are required to sign an indemnity form for all activities, prior to the departure of the activity. The indemnity form must be signed by a Parent/Legal guardian for children under 18 (eighteen) years of age. In the case of a guest refusing to sign the indemnity form, the guest will not be able to partake in the activity and will not receive any refund. 6. Forfeiture of Prize 6.1. The prize shall be subject to the prize winner and anyone accompanying them accepting and complying with any Health and Safety protocol in place at any Sun International property, including (but not limited to) Sun International’s Covid-19 health and safety protocols (accessible at https://corporate.suninternational.com/media/covid-19-protocols/). 6.2. Should the prize winner or anyone accompanying them refuse to comply with paragraph 6.1 and/or should the participant provide any false information to Sun International, and/or any violate any of the terms and conditions set out herein (as determined in Sun International's sole discretion), Sun International reserves its right to revoke the prize immediately and refuse them entry to its premises and/or pursue any remedy it has available to it under law, and this will result in the participant’s immediate disqualification as the winner of the prize and all of its privileges as winner will be immediately terminated without any claim against Sun International, its related-parties, management, employees and agents whatsoever in this regard. 6.3. In the event that the prize winner is unable to travel on the dates specified in the promotional campaign, the prize will be forfeited, and the prize winner shall not have any claim against Sun International, its related-parties, management, employees and agents whatsoever in this regard. 7. Sun International’s rights 7.1. If one of the following events occurs within South Africa which make it impossible and/or illegal for Sun International to perform any of its respective obligations under the promotional campaign, due to direct circumstances beyond its reasonable control (i.e. without its fault or negligence), including an act of God, natural disasters, acts occasioned by war, regulations or orders issued by the government [including but not limited to the outbreak of a contagious disease or pandemic (including as may be announced by World Health Organization (WHO)) such as Covid-19, epidemics, emergency situations curfews, evacuations, quarantine measures, prohibitions, or other restrictions], and/or civil disorder, then Sun International shall have the right to modify, suspend, extend or terminate the promotional campaign. 7.2. By accepting the prize, the participant consents to Sun International being entitled to use the guests name, likeness, and entry for purposes of marketing and advertising without compensation, to the extent permissible by law. Upon signing the Winner’s Declaration attached to the Letter of Award, the client requests images to be shared with them and the identification of the winner (persons in the image) is subject to their right to refuse. 7.3. To the fullest extent permitted by applicable law, Sun International, its related-parties, management, employees and agents assume no responsibility and are not liable for: 7.3.1. the accuracy or otherwise of the prize description or illustration provided; 7.3.2. the non-availability, loss, interception or interference with, late receipt or damage of or to any prize claimed; 7.3.3. other than those warranties or conditions implied by statute and which cannot be lawfully excluded by Sun International, any representation, warranty, condition or guarantee in respect of a prize; 7.3.4. any taxes, fees, charges or other costs which the prize winner may be required to pay at any time in connection with the redemption of the prizes; and 7.3.5. indemnity – all costs, injuries, losses or damages of any kind, due in whole or in part, directly or indirectly, to the participant, or arising out of its participation in any activity relating to the prize, or their receipt, use or misuse of any prize that may be awarded to them. 8. Children’s policy The ages of any children will be determined as at the date of check-in at the relevant Sun International hotel. 8.1. Family rooms at the Palace, Table Bay, Cascades, Soho, Cabanas, Lugogo, Royal Swazi and Wild Coast 8.1.1. Two Adults with two children of 12 years and under, or one child of 17 years and under, on a sleeper couch, including breakfast for a maximum of two children. 8.1.2. 1 Adult with two children of 12 years and under in respect of the Palace and the Table Bay or 17 years and under in respect of the remainder of the hotels specified, on a sleeper couch will be charged the single room rate including breakfast for a maximum of two children. 8.1.3. 1 Adult with three children will be charged the double room rate including breakfast for children. 8.2. Inter-leading rooms at the Boardwalk, Maslow, Time Square, and Meropa 2 Children of 17 years and under in their own room limited to two children per room. A discount of 50% of the rate quoted in the rate schedule is inclusive of breakfast and applies to one room per family. 8.3. Standard Double Room at Sibaya 8.3.1. 2 Adults with two children of 17 years and under in a two x double bedroom, exclusive of breakfast. 8.3.2. 1 Adult with two or three children of 17 years and under in a two x double bedroom will be charged the single room rate excluding breakfast for the children. 9. General 9.1. These Terms and Conditions are governed by the laws of the Republic of South Africa and the courts of the Republic of South Africa shall have exclusive jurisdiction in respect of any matters arising hereunder. 9.2. If Sun International makes any indulgence or deviation of these Terms and Conditions, then such indulgence or deviation shall not be misconstrued to be a breach or waiver of these Terms and Conditions or any of Sun International’s rights. 9.3. Any paragraph or part thereof which is found to be unenforceable in law shall be severed from the rest of these Terms and Conditions, and the surviving terms shall remain in force. 9.4. The competition will run from 15 November 2021 until 17h00 on 27 December. You may enter as many times as you like. Staff of Media24, Sun International and their families may not enter. 9.5. Prizes are as stipulated and does not include transfers. It is valid for midweek stay only. Prizes will be valid until 30 April 2022.
