Speaker Nosiviwe Mapisa-Nqakula announced that she would refer the African Transformation Movement's (ATM) Section 89 motion to an independent panel to determine whether there is a prima facie case for the president's removal in the wake of the Phala Phala scandal.

The rules allow the Speaker to appoint a panel after all political parties in Parliament have given their input. Mapisa-Nqakula gave parties until 1 September to share their recommendations.

The rules require three fit and proper, competent, experienced and respected South African citizens, which may include a judge, and who collectively possess the necessary legal and other competencies and experience to perform the preliminary assessment of the motion on the panel.
