Public Protector Busisiwe Mkhwebane relied on discredited and flawed investigations and reports in reaching her findings against former South African Revenue Service (SARS) commissioner Pravin Gordhan, while inexplicably ignoring documents and evidence.

The North Gauteng High Court in Pretoria on Monday handed down a scathing judgment, setting aside a July 2019 report by Mkhwebane that found Gordhan had violated the Constitution and intelligence laws around the establishment of an investigative unit at SARS in 2007.

Gordhan was the SARS commissioner at the time.
